petition under Article 226 of the Constitution of India is filed praying that
in the circumstances stated in the affidavit filed therewith, the High Court may
be pleased to issue Writ, Order, or Direction one in the nature of WRIT OF
MANDUMUS quashing the Regulations 41A of the Union Bank of India
(Employeesl) Pension Regulations 1995, dated 29091995 the contrary to the
welfare and against the interest of retired employees as the commuted
amount of pension is being already recovered in just 9 years 10 months as per
the respective pension payment Orders issued under the Regulations, where
my commutation Factor @ 9.81, Commutation Amount and Commutation
Date, Commuted Value and Date of Restoration stipulated on my
superannuation. No interest is being charged on the Commutation Amount as
per the Regulations. But recovery of commuted value is being recovered
every month from the pension amount and to be continued to be recovered by
the respondents till completion of 15 years from the date of Commutation.
consequently, to hold the same to the illegal and arbitrary being ultra vires of
the constitution of India as well as on the ground that the same is causing in
undue enrichment to the respondents and it also doesn't have any rational
objective and intelligible differentia to be achieve and pass Such Other Order Or
orders may deem fit and proper in the circumstances of the case. It is also
further prayed that this H.on'b'e Court may be pleased to directing the
respondents to restore Petitioners' full pension immediately on expiry Of 9
years 10 months instead of 15 years as provided for in Regulations Chapter
vlll, Clause 41(5) of the Union Bank of India (Employees') Pension
Regulations,1995 since the amount already stands recovered in excess from
the petitioners may kindly be returned with interest.

Petition under Article 226 of the Constitution of India praying that in the
circumstances stated in the affidavit filed therewith, the High Court may be

in the nature issue of WRIT OF MANDAMUS quashing the Regulations 41A
and 41 (5) of the Union Bank of India (Employees) Pension Regulations 1995,
dated 29091995, being contrary to the welfare and against the interests of
the retired employees, as the commuted amount of Pension was already
recovered in just 9 years and 10 months as per the respective Pension
Payment Orders issued under the Regulations, where the Commutation
Factor @ 9.81, Commutation Amount and Commutation Date, Commuted
Value and Date of Restoration stipulated on Superannuation. No Interest is
being charged on the Commutation Amount as per the Regulations. But
Commuted Value is being recovered every month from the pension Amount
and still being continued to be recovered by the 2nd Respondent Bank till
completion of 15 years from the Date of Commutation. Consequently, to hold
the same to be illegal and arbitrary being ultra vires of the Constitution of
India, as well as on the ground that the same is resulting in `unjust enrichment
of private money to the respondents by recovering the Commutation Amount
on the ground that the above Pension Regulations stipulated the condllion of
recovery for 15 years and it also doesnot have any rationale objective and
intelligible differentia to be achieved and grant stay of the excess recovery and
direct the Respondents to restore Petitioners full Pension immediately on
expiry of 9 years 10 months instead of completion of 15 years as provided for
in Regulations Chapter VllI, Clause 41 (5) of the Union Bank of India
(Employees) Pension Regulations, 1995 since the amount already stands
recovered in excess from the petitioners may kindly be refunded with Interest
from the respective dates of recovery from each petitioner pending disposal of

No interest is being charged on the Commutation Amount as per the Regulations.
