Order 20/12/2022 Learned counsel for the petitioners submits that in similar nature writ petition being Arvind Kumar Purohit & Ors. Vs. State of Rajasthan & Ors.: SBCWP No.18650/2022, a Coordinate Bench of this Court following the order in the case of Jagdish Saini & Ors. Vs. State of Rajasthan & Ors.: SBCWP No.17878/2022 at Jaipur Bench, has granted interim order while issuing notices and, therefore, similar order may be passed.
The Coordinate Bench of this Court in the case of Arvind Kumar Purohit (supra) referring to the order in the case of Jagdish Saini (supra), wherein, the recovery was stayed, ordered as under:-
"Meanwhile, recovery of the amount from the petitioners pursuant to the circular dated 06.09.2022 and office order dated 28.09.2022 (Annexure-5) shall remain stayed.
Regardless of the pendency of the present petition and interim order passed by this Court, the State shall consider petitioners' option to be covered by the Old Pension Scheme."
In view of the submissions made, the order passed in the case of Arvind Kumar Purohit (supra) would apply to the case of petitioners also.
