WRIT PETITION No.8984 of 2022
ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners, wherein the following prayer is made:
"...to issue any Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents more particularly respondent Nos.4 and 6 by illegally detaining the petitioners herein in respondent no.6 malakpet police station and constantly asking them to come appear before the respondent no.6 Malakpet Police station and trying to confine them as illegal, arbitrary and in violation of Articles 14, 21 and of Constitution of India besides in violation of principles of natural justice and consequently direct the respondents more particularly respondent nos.4 to 6 not to interfere into personal life and liberty of the petitioners without following the due procedure established by law and pass such other order or orders..."
2. Heard the learned counsel for the petitioners, learned Assistant Government Pleader for Home appearing for the respondents and perused the record.
3. The grievance of the petitioners is that the respondent-police are unnecessarily calling them to the police station and trying to confine them, which is illegal and arbitrary.

It is brought to the notice of this Court by the learned Assistant Government Pleader for Home that the children of the petitioners are arrayed as A8 to A10, A12 and A13 in Crime No.61 of 2022 of Malakpet Police Station, Hyderabad, registered for the offences under Sections 420, 465, 468, 471 r/w 34 of IPC. The petitioners are also arrayed as accused in the said crime and a notice under Section 41A Cr.P.C. was issued to them on 15.02.2022.

5. Learned Assistant Government Pleader for Home handed over the copies of said notices to the learned counsel for the petitioners in the open Court.
6. Learned counsel for the petitioners would submit that the petitioners are ready to comply with the conditions laid down in the said notices issued under Section 41A Cr.P.C. and the learned counsel for the petitioners seeks time to do so.
7. Under these circumstances, the petitioners are directed to comply with the conditions imposed in the notice issued under Section 41A Cr.P.C. within seven days from today. It is needless to say that the police concerned shall not take any coercive steps against the petitioners pending the notice issued under Section 41A Cr.P.C.
8. With the above direction, the Writ Petition is disposed of.
Miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
