ORAL ORDER
6 25-09-2019Heard learned counsel for the petitioner and learned APP for the State.
The petitioner has filed the instant application for anticipatory bail apprehending his arrest in connection with Mahila P.S. Case No. 118 of 2018 (District Nalanda) registered for the offence punishable under sections 341,323,504,506,379,313,34,498A and 494 of the Indian Penal Code and section ¾ of the Dowry Prohibition Act.
As per the allegation in the FIR, the petitioner got married to the informant in the year 2014. At the said time he was employed as an engineer in New Delhi. It is alleged that the informant's father gave gifts worth Rs. 15 lacs at the time of Patna High Court CR. MISC. No.27292 of 2019(6) dt.25-09-2019 2/3 marriage. It is further alleged that soon after the marriage, the petitioner started asking the informant to get Rs. 10 lacs from her father to enable him to purchase a flat. Thereafter, physical and mental torture started and in June, 2014 she was forced out of her Sasural. She was told that she would not be permitted in till she got Rs. 10 lacs and her ornaments were also retained.
It is submitted by learned counsel for the petitioner that the allegations as made in the FIR are false and concocted. The petitioner is very much willing to continue the relationship with informant. It is submitted that as a result of recession in the year 2017 he lost his job.
Pursuant to the order passed in the instant application on earlier occasion, both the petitioner as also the informant had appeared in Court in person. The Court had occasion to interact with them.
Having heard the learned counsel for the parties and taking into consideration the facts and circumstance of the case, the court is inclined to enlarge the petitioner on bail. The petitioner above named, in the event of his arrest or surrender in the court below within a period of six weeks from today in connection with Mahila P.S. Case No. 118 of 2018 (District Nalanda) is directed to be enlarged on bail on furnishing bail Patna High Court CR. MISC. No.27292 of 2019(6) dt.25-09-2019 3/3 bond of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Biharsharif, Nalanda subject to the conditions as laid down in Section 438 (2) of Criminal Procedure Code.
