2. We had heard this case earlier on 1 December 2009 and had adjourned the matter for hearing the final argument of the Respondent on the disclosure of the correspondence between the Bank on the one hand and the CBI and the CVC on the other relating to certain matters mentioned in the Appellant's original application. The case was heard through videoconferencing. Both the parties were present in the Mumbai studio of the NIC. The Respondent did not have any convincing argument against the disclosure of such records. After all, as reported, the enquiry instituted against the Appellant has been completed and the disclosure of the correspondence of the Bank with the above agencies will have no adverse impact on the course of that enquiry. In view of this, we direct the CPIO to provide to the Appellant within 10 working days from the receipt of this order certified photocopies of the entire correspondence between the Bank and the CBI and the CVC on the matter as mentioned in his original application for information.

3. In regard to the inspection of certain records, the Appellant submitted that while he was shown a number of files and records, there were some more which had not yet been made available. The Respondent informed that all those records had since been received from the respective offices and could be made available for inspection now. It was agreed that these records would be shown to the Appellant in the Zonal Office of the Bank in Mumbai on a date mutually convenient. We direct that the inspection should be arranged within 10 working days from the receipt of this order and copies of records and documents so inspected shall be provided to the Appellant if he desires to have copies of those.

4. With the above directions, the case is finally disposed off.

5. Copies of this order be given free of cost to the parties.

(Satyananda Mishra) Information Commissioner Authenticated true copy. Additional copies of orders shall be supplied against application and payment of the charges prescribed under the Act to the CPIO of this Commission.
