Section 402(1) in The Code of Criminal Procedure, 1989 (1933 A. D.)
(1)[The Governor] [Sadar-i-Riyasat substituted by Act X of 2010 for 'His Highness' and again 'Governor' substituted for 'Sadar-i-Riyasat' by the Constitution of Jammu and Kashmir (Sixth Amendment) Act, 1965.] may, without the consent of the person sentenced, commute any one of the following sentences for any other mentioned after it :-death, life imprisonment, rigorous imprisonment for a term not exceeding that to which he might have been sentenced, simple imprisonment for a like term, fine.
