Section 44(3) in The Punjab Minor Canals Act, 1905
(3)If, in the opinion of the [State Government] the application should, whether in whole or in part, be granted, it may declare that the land is required for a public purpose within the meaning of the Land Acquisition Act, 1894, and direct the necessary action to be taken thereunder.
