1. No time left. It is already 5.30 P.M.

2. We may note that Mr. S. Nanda Kumar, who appears on behalf of the appellant/ NHAI, says that compliance of the directions contained in the interim order dated 04.09.2017 has been made i.e., the amount, as directed, has been paid, subject to which the operation of the impugned award had been stayed. 2.1. Mr Jayant Mehta, learned senior counsel, who appears on behalf of the respondent, does not dispute this position.

3. However, Mr Mehta says that under the award, approximately Rs. 116 crores are payable. It is Mr Mehta‟s submission that the Arbitral Tribunal has quantified this amount as payable to the respondent, after applying clause 31.2 of the subject contract.

3.1. This aspect will be examined once the appeal is taken up for adjudication.

4. The interim order dated 04.09.2017 is made absolute during the pendency of the appeal.

4.1. CM APPL. 19315/2017 is, accordingly, disposed of.
