1.Filing this application under Section 401 read with Section 482 of the Code of Criminal Procedure, 1973, the petitioner praying for quashing of proceeding being Special Case No. 6 of 2016 (New Case No. SEBI/5/2017) under Sections 56, 60 and 70 read with Sections 56, 60 read with Section 2(36), 73 of the Companies Act, 1956 read with Section 465 of the Companies Act, 2013 and the SEBI (Disclosure and Investor Protection) Guidelines, 2000, read with SEBI (Issue of Capital and Disclosure Requirements) Regulation, 2009 (The ICDR Regulations), being punishable under Section 24/27 of the Securities Exchange Board of India Act, 1992.
2. This case is pending since 2013. In spite of long pendency, none appears on behalf of the petitioners at the time of call. No accommodation is sought for. Even on the earlier occasion, none appears on 2 behalf the petitioner and no accommodation sought for.
3. In the above circumstances, it appears that the petitioners are no more interested to pursue the instant case.
4. Accordingly, CRR 192 of 2019 is, thus, dismissed for default.
5. Interim orders, if any, shall stand vacated.
6. Let a copy of this order be communicated to the learned Trial Court for information.
