Per Justice K.C. Joshi, Judicial Member We are proposing to decide the Misc. Application Nos.329, 330, 331, 332, 333, 334, 335, 336, 337, 338, 339, 340, 341, 342, 343, 344, 345, 346, 347, 348, 349 & 350 of 2013 and Misc. Application Nos. 00002, 00003, 00004 and 00005 of 2014 by this common order because by a common order the original application Nos.425, 428, 429, 430, 431, 432, 433, 435, 436, 437, 438, 439, 440, 441, 443, 444, 446, 447, 460, 461, 462, 463, 426, 427, 442 and 448 of 2011 have been remanded back to this Tribunal by the Honble Rajasthan High Court vide its judgment dated 22nd November, 2012 and the applicants and respondents were directed to remain present before this Tribunal on 07.01.2013. But, inadvertently, none of the parties filed any application before this Tribunal and lastly on 17.09.2013 the counsel for the applicant, Mr. Hemant Jain, filed the above mentioned Misc. Applications for restoring the respective OAs. Total 26 Misc. Applications bearing Nos. 329, 330, 331, 332, 333, 334, 335, 336, 337, 338, 339, 340, 341, 342, 343, 344, 345, 346, 347, 348, 349 & 350 of 2013 and Misc.Application Nos.00002, 00003, 00004 and 00005 of 2014 have been filed by the counsel for the applicants and the copies of the same have been provided to the counsel for the respondents, Smt. K. Parveen.

2. Although no application for restoring of the OAs as directed by Honble High Court was filed on 7.1.2013 and the aforementioned Misc. Applications have been filed at a belated stage i.e. on 17.9.2013, but looking to the fact that the cases should be decided on merit and on technical grounds the cases should not be dismissed because to decide the case on merits always advances the cause of justice, therefore, all these Misc. Applications are allowed and their respective Original Applications are restored to its original number and status.

3. Now we are proceeding to decide the Original Applications.

Since, all these original Applications are similar in nature, therefore, for deciding the matter, we are taking the facts of the OA No.425/2011 (Suraj Bhan & Ors.) as a leading case. The short facts of the case are that the applicants are defence civilians working in the Indian Army as Mazdoors from the date of their initial appointment. The respondent No.1 vide letter dated 14.4.1981 declared as many as 8 areas of Rajasthan as Modified Field Areas. The service personnel as well as the defence civilians, such as applicants, get the allowances, as prescribed, while working at the Field Area or the Modified Field Area, as the case may be. Prior to 1994, the applicants were getting the ration money as an allowance for working in the Modified Field Area apart from salary but after the year 1994, the same was stopped. The All India Defence Employees Federation has also raised the issue of giving the Modified Field Area Allowance before the respondents. The applicants also represented to the respondents for grant of Modified Field Area Allowance, but no heed was paid to their demand. The applicants also sent a legal notice to respondent No. 2 and 3 for grant of Modified Field Area Allowance. While the applicants were pursuing the matter of getting Field Area Allowance at least from the date of circular dated 21.9.2000, it came to their knowledge that the respondents are proceeding to recover the money paid to them as an allowance for working and rendering service in Operation Parakram from 14.12.2001 to 18.3.2003. The Director of Audit, Defence Services during its audit pointed out that the compensation was paid to the defence civilians of 24 FAD and AD Bhatinda for their deployment on Operation Parakaran. It was observed that the Field Area Allowance paid to the service personnel of the same unit for the same purpose was found to be irregular and recovered from them. The applicants submit that a communication dated 20.4.2010 was issued by the Director (CP) (MP) whereby it was stated that the matter with regard to grant of Field Service Concession to defence civilians of 24 FAD and AD Bhatinda, has been examined and it has been decided that in case of defence civilian of 24 FAD, the Field Service Concession would be restricted to grant of Modified Field Area Allowance at par with the service personnel who were on the same footing.

The applicants have further submitted that the respondents are doing hostile discrimination by not allowing Modified Field Area Allowance even as per the circulars and direction of respondent No.1 and on the other hand, they are seeking to effect recovery for the amount which was paid to them during the Operation Parakaram. It has been averred that the said allowance was sanctioned by the Honble President of India and the same cannot be ordered to be recovered only on the basis of audit objection.

The applicants have also submitted that they are legally entitled for grant of Modified Field Area Allowance from the date of their initial appointment or from 21.9.2000 i.e. the date of circular issued by respondent No.1, whichever is later, but the respondents have wrongly and illegally withheld the same and, on the other side, they have passed impugned orders whereby it is stated that Field Service Concession would be restricted to grant of Modified Field Area Allowance and the excess amount shall be recovered. Therefore, aggrieved by the action of the respondents, the applicants have filed the above OAs praying for the following reliefs:-

i. It is therefore, most respectfully prayed that this original application may kindly be allowed and the respondents be directed to comply with the directions and instructions given in the circular dated 21.09.2000 (Annexure A-3), in letter and spirit, and to allow and release the amount of Modified Field Area Allowance alongwith 12% interest, as admissible to each of the petitioner, from the date of the circular dated 21.09.2000 or the date of their initial appointment, whichever is later; and ii. That that the Impugned Orders dated 20.04.2010 (Annexure A-1) & 30.04.2010 (Annexure A-2) passed by the Respondents as also the recovery proceedings taken up against the Applicants for the recovery of amount paid as Field Service Concession to the Applicants for rendering their services in operation parakaram, may kindly be quashed and set-aside; and iii. That if any recovery is effected, in pursuance and compliance of the orders dated 20.04.2010 (Annexure A-1) & 30.04.2010 (Annexure A-2) or any such orders, during the pendency of this Original Application, the same may also be declared illegal and the same may also be quashed and set aside; and iv. The cost of this Original Application may kindly be awarded in favour of the Applicants; and v. Any, other Order or Direction which this Honble Tribunal deem just and proper in the facts and circumstances of the case may kindly be issued in favour of the applicants.

By way of filing reply, the respondents have denied the right of the applicants and have submitted that the circular dated 21.9.2000 provides only for grant of Field Service Concession to defence civilians in specified areas and it does not provide for any Field Area Allowance as claimed by the applicants. It has been further submitted that as per Government policy letter on subject of granting concession in Field/Modified Field Area, army personnel are authorized for monetary concession because of nature of job while defence civilian employees are authorized for the concessions which are non-monetary. Further, after re-designation of Lalgarh Jattan from Full Field Service Concession Area to Modified Field Service Concession Area, the concessions which became admissible to the defence civilian employees were non-monetary as per Ministry of Defence letter dated 31.10.1995 and there was no provision of Ration Money in lieu of free ration. These concessions were granted upto 31.3.1994 vide letter dated 8.12.1993. The respondents have further submitted that the instructions enumerated in Government of India, Ministry of Defence letter dated 21.9.2000 are being implemented as all allowances admissible are non-monetary in nature. Further, in terms of Ministry of Defence letter dated 6.3.2006, the civilian employees of 24 FAD were paid Operation Parakram Allowance w.e.f. 19.12.2001 to 18.3.2003 for services rendered during Operation Parakram and the said allowance was paid after getting the same pre-audited by Principal Controller of Defence Accounts, South Western Control, Jaipur. The Field Service Concessions in the Field/Modified Field Area are paid to the defence civilian employees on the analogy that service personnel are entitled to Field/Modified Area Allowance. In the instant case, Field Area Allowance paid to the service personnel was restricted to the Modified Field Area Allowance. This created a situation where operation allowance not admissible to the military personnel has been allowed to the defence civilians, who were on the same footing, which was objected by the audit and the orders of recovery were issued. Further, the payment on account of Field Service Concession made to the defence civilian employees is irregular since they were entitled only to concessions under Modified Field Area at par with the army personnel during Operation Parakram. Therefore, the respondents have averred that the applicants have no case in their favour and thus they are not entitled for any kind of relief as prayed for.

5. Earlier, while deciding all these Original Applications vide order dated 12.12.2011, this Tribunal has passed the following directions:-

There now appears to be some confusion, as the applicants would claim that they are entitled to such benefits, which should be given to them, but probably the issue may be as to what their quantum of benefits should be. Therefore, to provide harmony, we are issuing the following declarations and directions:-
(i) The respondents shall undertake a further survey of Field Areas and Modified Field Areas on the basis of geographical significance as well as functional content, and determine the workload and risk feature of each area, and make an intelligible differentia, which is to be applicable to both uniformed personnel and Defence Civilians doing a similar or particular category of work. The feasibility of work related and risk related study shall take into consideration the quantum of compensation required to be received by each kind of personnel in relation to his situational significance. The concept of risk feature of uniformed personnel vs. defence civilian functional content and risk element also shall be taken into account while deciding the matrix.
(ii) After having established a differentia between the two functional elements, on the basis of work content and its features, a structure of compensatory allowances which is related to the present time, and keeping in mind the various pay structure available after the Sixth Pay Commission, shall be formulated and arrived at.
(iii) These, thereafter, shall be made available, within six months from today, to the applicants, and those like them, with arrears from 09.10.2011, i.e. the date of O.A., without any interest and thereafter after the six months period with interest at the rate of 10% per annum.

Thereafter, the Honble Rajasthan High Court, while dealing with the above observations in D.B. Civil Writ Petition No.3956/2010 (Teja Singh & Ors. Vs. UoI & Ors with 57 connected matter), set aside the above orders and remanded the case back to this Tribunal to arrive at a considered decision in the matter with reference to the factual and legal aspects put forth by the parties.

6. We have heard both the parties. Counsel for the applicants contended that the applicants submitted a detailed representation at Annexure-A/7 and thereafter a legal notice at Annexure-A/8. The Director (CP) (MP), for Adjutant General Branch issued a letter dated 29th March, 2010 (Ann.A/6) to the Headquarter, South Western Command in response to Annexure-A/5 to comply with the order dated 21st September, 2000 (Annexure-A/3) in letter and spirit. As the matter is pending before the competent authorities in administrative side and the Annexure-A/7 and A/8 have not been responded by the competent authorities and it is still pending consideration, therefore, we are intending to dispose of these original applications with certain directions.

Accordingly, the respondents are directed to decide the representation (Annexure-A/7 in OA No.425/2011) as well as Legal Notice (Annexure-A/8 in OA No.425/2011) pending before them within a period of six months from the date of receipt of a copy of this order in the light of order dated 21st September, 2000 (Annexure-A/3) issued by the competent authority and further for this purpose, these original applications shall also be treated as representations in addition to the representation at Annexure-A/7 and Legal Notice at Annexure-A/8. In case, after the decision made by the respondents further grievance, if any, remains, the applicants would be at liberty to file fresh OAs.

8. With the above directions and observations, all the Original Applications are disposed of with no order as to costs.
