                                     ORDER

Information sought:

The Appellant filed an online RTI Application dated 25.10.2020 seeking information on the following four points:

"Subject : ALIGARH MUSLIM UNIVERSITY ALIGARH (UP) Advertisement No. 2/2019(T) (1) Dated: 16.02.2019 - The Interview for Professor (Serial No:

26), Associate Professor (Serial No: 27) and Assistant Professor (Serial No:

28) has been conducted on 23.10.2020 & 24.10.2020 for College of Nursing Regarding:

1) I need the Copy of list of selected candidate for an interview for the post of Professor, Associate Professor and Assistant Professor.

2) I need the Copy of API Score of selected candidate for the aforesaid interview at College of Nursing.

3) How many candidate were fulfilled the eligible experience as per your notification among the received applications. I need the copy of eligible and non eligible candidate list.

4) Are you recruiting the Teaching staff as per UGC norms 2018?

Kindly issue the aforesaid details as soon as possible."

Shri Haseeb Baig,SO/CPIO, Selection Committee Section (Teaching), Aligarh vide letter dated 08.11.2020, denied information to the Appellant as under:

CIC/ALMUV/A/2021/600409 Being dissatisfied, the appellant filed a First Appeal dated 25.11.2020, which has not been adjudicated by the First Appellate Authority as per available records.

Grounds for Second Appeal:

The Appellant filed a Second Appeal u/s 19 of the Act on the ground of unsatisfactory reply furnished by the Respondent. Appellant requested the Commission to direct the CPIO to provide complete information sought for.

Submissions made by Appellant and Respondent during Hearing:

The Appellant did not participate in the hearing despite being served the hearing notice.

The Respondent submitted that the relevant information as sought in the instant RTI Application could not be given to the Appellant as the averred interview was under process at that point. He further added that the requisite information regarding the selected candidates in the averred interview has been given to the Appellant in some other RTI Application.

A written submission has been received by the Commission from Shri Haseeb Baig, Former CPIO, Selection Committee Section (Teaching), AMU, Aligarh vide letter dated 21.05.2022, wherein the Commission has been apprised as under:

CIC/ALMUV/A/2021/600409 Decision:

Upon perusal of the facts on record as well as on the basis of the proceedings during the hearing, the Commission observes that though an appropriate reply has been provided by the Respondent on point no. 2 of the RTI Application, the reply provided by the Respondent on point no. 1 and 3 of the RTI Application is not satisfactory. Hence, the Commission directs the present CPIO to provide revised reply on point no. 1 and 3 of the RTI Application to the Appellant, with a copy marked to the Commission, within 10 days from the date of receipt of this order.

The Commission further observes that point no. 4 of the RTI Application has not been attended by the Respondent and the said conduct is admonished. Hence, the Commission directs the present CPIO to provide a fresh and specific reply qua point no. 4 of the RTI Application to the Appellant, with a Page 4 of 6 CIC/ALMUV/A/2021/600409 copy marked to the Commission, within 10 days from the date of receipt of this order.

With the above observations, the instant Second Appeal is disposed of. Copy of the decision be provided free of cost to the parties.

The Appeal, hereby, stands disposed of.
