2 19-05-2017Heard learned counsel for the petitioner and learned counsel for the State.
Petitioner apprehends his arrest in connection with Bagaha (Mahila) P.S. Case No. 29 of 2016 registered under Sections- 366A/ 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the victim in her statement under section 164 Cr.P.C. has stated that she went with petitioner for the purpose of marriage with her own will. Victim is a major girl. On medical examination, doctor has assessed the age of the victim to be 17-18 years. Petitioner has no criminal antecedent.
Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or Patna High Court Cr.Misc. No.20446 of 2017 (2) dt.19-05-2017 2/2 surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Bagaha, West Champaran, Bettiah in connection with Bagaha (Mahila) P.S. Case No. 29 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
