Item Nos. 03 Original Application No. 117/2014 to 5 We have perused the relief sought in this application September 20, 2016 and are of the opinion that the applicant needs to AK convince this tribunal that the relief sought is within the jurisdiction of the Tribunal. List it on 20th October, 2016.
Original Application No. 499/2014 List this matter along with Original Application No. 117/2014 on 20th October, 2016.
M.A. 579/2016 in Original Application No. 102/2014 The applicant seeks an order to implead himself on the plea, he is a necessary and proper party to the proceedings as he is concerned with the raised in the case and wants to question misuse of fertile earth for making red bricks 3 etc. Several factual aspects has been mentioned in the application to justify his participation in the proceeding.
It is stated that copies of the application has been severed on the respondent who would be required to meet the ground if any that the applicant would urge during the consideration of the main application on merit.
As of now, we have no objection to said application from any of the parties in these proceedings.
At this juncture, our attention is drawn to the order dated 11th May, 2016, in Original Application 214/2016. By that order this Tribunal had permitted the present applicant to withdraw his applicant which was M.A. NO. 409/2016 in the said proceeding with liberty to apply in the present case.
The order is clear in its terminology that while finding no sufficient ground to allow participation of the applicant in those proceedings, he was granted liberty as sought for to seek intervention in this proceeding.
In view of such order no further detail consideration is necessary. We therefore, allow this application permitting the applicant to be impleaded in these proceedings as additional respondent.
The Original Applicant is directed to implead him and memo of parties be filed in this case. The impleaded applicant is granted two weeks time to reply to the applicant after finishing copy to the Learned Counsel for the Original Applicant who may file rejoinder if any.
At this juncture we also direct the applicant to serve copies of the reply to the respondent and other parties who may be directly or indirectly required to 4 meet the grounds that he urges.
