04. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. The present Interlocutory Application U/S.5 of the Limitation Act, 1963 has been filed by the appellant to condone the delay of 31 days in preferring the appeal.
3. Heard, learned counsel for the appellant.
4. At the outset, Mr. B.B. Singh, learned counsel has already entered appearance for Respondent No.1 by waiving notice and, therefore, he may be supplied with a copy of the brief by tomorrow.
5. In the aforesaid facts and circumstance, issue notice on limitation against Respondent Nos. 2 and 3 by Speed Post/Registered Post with AD fixing a short returnable date. Requisites for issuance of notice shall be filed within three working days.
