1. Allowed subject to all just exceptions.
2. Application stands disposed of.
BAIL APPLN. 3623/20233. The present petition has been filed seeking grant of interim bail in FIR No.207/2019 registered at Police Station Special Cell under Sections 3 and 4 of the MCOC Act.
4. The petitioner seeks interim bail on account of knee replacement surgery of his mother, who is aged about 68 years. Necessary medical documents have been filed along with the present application.
5. In the status report filed by the State before the Trial Court, it is stated that the applicant and his associates have committed several heinous crimes including murder and extortion. Details of the previous involvement This is a digitally signed order.

6. Counsel for the applicant submits that out of 11 cases applicant has been granted bail in 9 cases. Pertinently, applicant has not been granted bail in FIR No.226/2018, which is under Section 302 of the IPC.
7. Though the factum of surgery has been verified by the State. However, it is stated in the status report that the petitioner has one brother and four sisters. The brother of the applicant, who resides in Delhi, works as a crew member in Air India. Some of the sisters of the applicant also reside in Delhi.
8. Counsel for the applicant submits that the brother and other family members do not look after the parents in view of the criminal activities of the applicant.
9. This Court finds it hard to accept the submission that the remaining family members of the petitioner have disowned their parents only on account of the criminal activities of the applicant.
10. Trial Court in its order rejecting bail has also noted that there is a strong apprehension regarding the applicant absconding and/or intimidating witnesses.
11. Considering the totality of facts and circumstances and also taking note of the fact that the knee replacement is only an elective surgery, this Court is not inclined to enlarge the applicant on bail.
12. Accordingly, the application is dismissed.
