SUMEET GOEL, JUDGE (Oral)
1. The substantive prayer made in the instant petition reads thus:
"It is, therefore, respectfully prayed that the instant petition be allowed and the petitioner may kindly be granted Regular Bail in FIR no. 29 dated 07.03.2025 (Annexure P-1) registered Under Sections 22, 27-A, 29/61/85 NDPS Act registered at Police Station Banur, District Patiala in the interest of Justice.
It is also most respectfully prayed that the petitioner may kindly be released on interim bail on humanitarian grounds as the infant son of the petitioner is undergoing medical complications requiring immediate hospitalization and surgery, in the interest of justice, equity and good conscience."
2. At the outset, learned counsel for the petitioner has submitted that she does not press the plea for regular bail and is only pressing for interim regular bail for a period of one month. In order to buttress her arguments, 1 of 4 ::: Downloaded on - 09-11-2025 12:35:23 ::: CRM-M-55205-2025 (O&M) Page |2 learned counsel for the petitioner has relied upon paragraph No.5 of the petition, which reads thus:
"5. Humanitarian ground as 1 month old son of the petitioner fighting for life in PGI: That the petitioner earnestly prays for interim bail on compelling humanitarian grounds. The petitioner's newborn baby, barely a month old, is presently fighting for his life at the PGIMER, Chandigarh. Medical records show a terrifying picture for any parent: multiple cysts in the kidneys; the left pelvi-calyceal system is grossly dilated with marked parenchymal thinning and reduced cortical thickness, and the urinary bladder is partially distended with mural thickening. The child is under continuous observation of specialist doctors at PGI and has been advised urgent surgical intervention. The petitioner is the only earning hand in the family and the sole person able to arrange for, accompany and consent to the child's treatment and surgery; the only other adult male is the petitioner's father, who is an aged senior citizen and physically incapable of providing the necessary care. The petitioner's absence at this juncture would not only deprive the infant of a father's presence at the most critical moment of his life but would also place an impossible emotional and logistical burden on an elderly family member. In these heart-rending and exigent circumstances, it is submitted that basic humanity and the petitioner's duty as a father require that he be granted interim bail to be with his dying child, to make urgent medical decisions, and to provide the care that only a parent can. A copy of the medical record is annexed herewith as Annexure P-4."
3. Learned State counsel has filed additional affidavit dated 12.10.2025 of Shri Manjit Singh (PPS), Deputy Superintendent of Police, Rajpura, District Patiala, relevant where of reads thus:
"5. That in light of the aforesaid verified medical information, it is respectfully submitted that while the petitioner's minor child is indeed suffering from a serious congenital renal condition, the treatment thereof does not presently necessitate the continuous physical presence of the petitioner, inasmuch as no date or schedule for any surgical intervention has, as yet, been fixed or communicated by the hospital authorities.

Having heard learned counsel for the rival parties and upon perusal of the record, this Court deems it appropriate to grant the petitioner interim regular bail for a period of one month from the date of his actual release from jail. Accordingly, the petition is disposed of and the petitioner is ordered to be released on interim regular bail for a period of one month, on his furnishing bail/surety bonds to the satisfaction of the Ld. concerned trial Court/Duty Magistrate. However, in addition to conditions that may be imposed by the concerned trial Court/Duty Magistrate, the petitioner shall remain bound by the following conditions:
(i) The petitioner shall not mis-use the liberty granted.
(ii) The petitioner shall not tamper with any evidence, oral or documentary, during the trial.
(iii) The petitioner shall not absent himself on any date before the trial.
(iv) The petitioner shall not commit any offence while on bail.
(v) The petitioner shall deposit his passport, if any, with the trial Court.
(vi) The petitioner shall give his cellphone number to the Investigating Officer/SHO of concerned Police Station and shall not change his cell-phone number without prior permission of the trial Court/Illaqa Magistrate.
(vii) The petitioner shall not in any manner try to delay the trial.
(viii) The petitioner shall submit, on the first working day of every month, an affidavit, before the concerned trial Court, to the effect that he has not been involved in commission of any offence after being released on bail. In case the petitioner is found to be involved in any offence after his being enlarged on bail in the present FIR, on the basis of his affidavit or otherwise, the State is mandated to move, forthwith, for cancellation of his bail which plea, but of course, shall be ratiocinated upon merits thereof.
5. In case of breach of any of the aforesaid conditions and those which may be imposed by concerned trial Court/Duty Magistrate as directed hereinabove or upon showing any other sufficient cause, the State/complainant shall be at liberty to move cancellation of bail of the petitioner.

6. Nothing said hereinabove shall be construed as an expression of opinion on the merits of the case.
7. Since the main case has been decided, pending miscellaneous application, if any, shall also stands disposed off.
