                                       ORDER

1. Vide order dated 15.04.2025, the Commissioner, Municipal Corporation, Faridabad was directed to give in his report all requisite details regarding steps taken for compliance with directions given vide order dated 05.07.2023 passed in M.A. No.69/2022 in Original Application No. 331/2022 and Execution Application No. 26/2022 in Original Application No.331/2022 titled Omprakash Vs. State of Haryana & Ors.

2. Reply dated 11.11.2025 has been filed by MC, Faridabad. Relevant part of the reply reads as under:-

"2. That in compliance of the above said orders, Action Taken Report in the shape of an affidavit is required to be filed before this Hon'ble Tribunal for which repeated directions have been issued by the answering respondent to all the Joint Commissioner's including the Assistant Engineer's (Enforcement) to comply with the orders of this 1 Hon'ble Tribunal in true spirit. It is pertinent to mention here that a meeting was also convened by the answering respondent on 31.10.2025 and thereafter on 08.11.2025 and strict directions have been issued in this regard. Furthermore, it was also directed that in case of non-compliance of the order passed by this Hon'ble Tribunal concerned Joint Commissioner shall remain present before the Hon'ble Commissioner with specific explanations.

That Joint Commissioner(B) has submitted his report mentioning therein that 15 notices have been issued to the encroachers and 2 religious structures from Shri Ram Temple (in Park near H.No. 231, Sector-22) and Temple (in Park near H.No. 512, Sector-3) have been shifted. The said structures have been mentioned in the list at Sr. No. 56 & 688 respectively as already attached with the previous affidavit. Furthermore, in compliance of the said directions, the Municipal Corporation Faridabad (Ballabgarh Zone) initiated necessary actions. Demolition notices were duly issued to the A Rnauthorized religious structures on 24/10/2025, thereafter preparations for veca implementing the demolition were made in accordance with the Hon'ble Faridabad BY GO OF Court's directions. However, due to significant public interference and resistance at the sites, the demolition activities could not be carried out as planned. The situation on the ground posed challenges in maintaining public peace and law and order. The report of Joint Commissioner(B) is annexed as Annexure R-3/A.

4. That Joint Commissioner(T) has mentioned in his report that 39 religious structures fall in NIT Zone and a public notice has been pasted on conspicuous locations of all these structures. It is to mention here that to ensure effective enforcement, a request for appointment of a Duty Magistrate was made to the Deputy Commissioner, Faridabad, vide letter No. MCF/AE(B)/2025/967 dated 08.11.2025. In response, Sh. Karan Singh Bhagoria, Joint Commissioner, Ballabgarh, was appointed as Duty Magistrate. With the help of the encroachment removal staff and with adequate police force, an encroachment removal drive was conducted on 10.11.2025, during which the following six unauthorized religious structures were removed from green belt areas:

1. Baba Amarnath Shiv Mandir, Hardware Bata Road, NIT Faridabad.
2. Hanuman Mandir near Hardware-Bata Road (near Coal ki Taal), Faridabad. 3. Durga Mandir, Bata Chowk near Two-Wheeler Market (corner temple), Faridabad.
4. Shani Dev Mandir, Neelam Bata Road, near Delite Hotel, NIT Faridabad.
5. Mata Sati Mandir/Sita Ram Hanuman Mandir, near Railway Fatak, NIT Faridabad.
6. Pipleshwar Mahadev Shani Mandir, near Mulla Hotel, 3-H Block, NIT Faridabad.

It is pertinent to mention here that a second request for appointment of Duty Magistrate has been made vide letter No. MCF/AE(B)/2025/970 dated 10.11.2025, and Joint Commissioner(T) has been appointed as Duty Magistrate for the said purpose. Encroachment removal drive will be conducted with full police presence and support of the encroachment staff on 11.11.2025 and the following four religious structures would be removed from green belt areas:

1. Peer Ka Majar, Dabua Pali Road.
2. Majar, Sohna Ballabhgarh Road.
3. Peer Majar No. 2, Dabua Pali Road.
4. Hanuman Temple near FCI Godown, in front of Dua Ice Factory.
The report of Joint Commissioner(T) is annexed as Annexure R-3/B.
5. That the Joint Commissioner (GF) has submitted his report that no religious structure exists on the green park/belt in Greater Faridabad Zone. The report is annexed as Annexure R-3/C.
6. That Joint Commissioner(F) has submitted his report mentioning therein that 44 notices have been issued to the encroachers and the notices have been pasted on conspicuous locations of all these structures. Thereafter preparations for implementing the demolition were made in accordance with the Hon'ble Court's directions.

However, due to significant public interference and resistance at the sites, the demolition activities could not be carried out as planned. The situation on the ground posed challenges in maintaining public peace and law and order. It is to mention here that representatives of the concerned religious structures were called for a meeting, and after due consultation, it was mutually agreed to relocate two (02) of such structures to alternative suitable sites. Accordingly, one number of structure was completely sifted/removed and another one could not be shifted from site completely due to public opposition (Photo enclosed). The Report of the Joint Commissioner(F) is annexed as Annexure R-3/D.

That sincere efforts are being made by the answering respondent to comply with the order passed by the Hon'ble Tribunal as the matter is related to the removal of religious structure, resistance had to be faced by the concerned Joint Commissioners, furthermore, the Joint Commissioner(B) & (F) have further mentioned in their report that due to in-adequate police force, demolition plan could not be implemented. however it has been assured by the Senior Officers that proper police force as sought will be provided as and when required. The answering respondent hold this Hon'ble Tribunal in the highest esteem and can never think of disobeying the order passed by this Hon'ble Tribunal. It is humbly submitted Participation of Public/RWA is being impressed to get the idols shifted to appropriate place so that public resistance can be mitigated and issues can be resolved forever by avoiding such occurrence by residents. This exercise is time taking exercise but effective and appears as most appropriate. In view of the submissions made herein above, it is, therefore humbly prayed before this Hon'ble 3 Tribunal to provide three months' more time to comply with the order and submit the report."

3. Learned counsel for respondents no. 1 to 4 seeks time for filing additional compliance reports.

4. Additional compliance reports be filed at least one day before the next date of hearing fixed.

5. List on 12.01.2026 for further proceedings/orders.
