Heard Sri Tarun Tiwari, learned counsel for the petitioner, Sri F.A. Ansari, learned counsel appearing for respondent nos.2 & 3, Sri D.S.Chauhan, learned counsel appearing for respondent no.1 and perused the record.

By means of this writ petition, under Article 226 of the Constitution of India, the petitioner has prayed for the disposal of his application for grant of new connection.

It is submitted that some dispute is going on with the landlord and the petitioner and it is on account of that dispute that the respondent electricity department is not granting new connection to the petitioner.

In our considered opinion, this aspect of the matter is fully covered by the relevant clauses of U.P. Supply Code of 2005 whereunder if an application is moved on the format as provided for under Annexure 4.2 of the U.P. Supply Code, 2005 which is specifically meant for the purposes of those who are in occupation of the building and not the owner of the building, there is no occasion for the respondent to keep the application for new connection pending.

In such above view of the matter, we are disposing of this writ petition with the direction to the respondent no.2 to consider the application of the petitioner for grant of new electricity connection if the petitioner submits an application on the format of Annexure 4.2 of the U.P. Supply Code, 2005 within a period of two weeks from today and the decision shall be taken by the authority concerned within a further period of four weeks.
