Madhya Pradesh High Court

Rajni Gupta vs The Director General Of Police on 27 April, 2018

                           1

 HIGH COURT OF MADHYA PRADESH:JABALPUR
              Writ Petition No.9488/2018
Dated: 27.04.2018
Shri Rajesh Kumar Sen, learned counsel for the
petitioner.
Shri Naveen Dubey, learned Govt. Advocate for
the respondents-State.

Heard on admission.

By way of this writ petition filed under Article 226 of the Constitution of India, the petitioner is seeking the following reliefs:

"A) It is, therefore, prayed that this Hon'ble Court may kindly be pleased to direct the Respondents to take action on the petitioner's complaint as earlier possible.
B) Any other relief as deemed fit and proper in the circumstances of this case, along with the cost of this writ petition be also awarded."

The petitioner in support of his contention, has relied upon the judgment of the Hon'ble Apex Court in the case of Lalita Kumari Vs. State of UP & others, reported in (2014) 2 SCC 1.

From the record filed along with the petition it appears that the petitioner has been dupe by one Jitendra Kumar Singh, who had pressurized her to make physical relationship on the pretext of marriage.

In the considered opinion of this Court, no relief as sought by the petitioner can be granted to him, as the petitioner has an alternative remedy of filing a private complaint under the Cr.P.C. against the accused person.

Accordingly, the petition stands dismissed with the aforesaid observations.
