18. Ms. Shrutima Ehersa, counsel appearing on advance notice on behalf of the defendant no. 26 (Google LLC), accepts summons in the suit and waives issuance of formal summons.

19. Summons be issued to the remaining defendants by all permissible modes. The summons shall state that the written statement(s) shall be filed by the defendants within thirty days from the date of receipt of the summons. Along with the written statement(s), the defendants shall also file affidavit of admission/denial of the plaintiff's documents, without which, the written statement(s) shall not be taken on record.

25. This application has been filed by the plaintiff under Order XI Rule 2 CPC as amended by the Commercial Courts Act, 2015, read with Section 151 CPC, seeking administration of interrogatories upon the defendants.

The present suit has been filed seeking relief of permanent injunction restraining the defendants from engaging in widespread and unauthorized acts amounting to infringement of the plaintiff's copyright and trademark, passing off, dilution and unfair competition, tarnishment, damages, delivery up, rendition of accounts, etc., in relation to the iconic Hindi-language feature film "Andaz Apna Apna", along with other ancillary reliefs.

The plaintiff is an Indian production house, founded by the late Mr. Vinay Kumar Sinha, who was a highly respected and veteran producer in the Indian film industry, widely recognised for his deep understanding of cinema, his discerning creative instincts, and his longstanding contribution to Hindi-language films.

33. It was under his production, the Hindi film "Andaz Apna Apna"

('film') was made in the year 1994 (recently re-released after 31 years, on 25 April 2025), which is the subject matter of the present suit. The film was a project that he nurtured with great creative vision and personal investment. Mr. Vinay Kumar Sinha passed away in 2020 and was succeeded by his legal heirs, Mr Shanti Vinay Kumar Sinha (plaintiff herein), Ms Priti Sinha, Ms Namrata Sinha and Mr Amod Sinha, who have inherited all right, title and interest in relation to Mr. Vinay Kumar Sinha, through whom the present lawsuit has been filed.

34. The plaintiff owns exclusive rights to all concepts, formats and the intellectual property related to the film. While certain exploitation rights with respect to the film such as streaming, and making the film available on different mediums and platforms, have been assigned for a limited period, it is submitted that all the rights in the title, format, which inter alia, include rights to the character, characterization, dialogues, dialogue delivery, mannerism, style of characters, costumes, overall look of the character including hair, make up and costumes etc, along with all underlying literary, dramatic, artistic work in the said film, derivative and adaptation rights in respect thereof, are all owned by the plaintiff.

36. It is averred that each of the principal characters of the movie 'Andaz Apna Apna' has cultivated an independent fan base. For instance:

a. Crime Master Gogo, with his over-the-top costume, quirky catchphrases, and comically villainous behaviour, remains one of the most beloved comedic antagonists in Indian film. b. Amar and Prem, with their contrasting personalities, one sly and talkative, the other naïve and endearing, exemplifying the classic comic duos, thereby setting a benchmark for buddy comedies in Bollywood.

c. Teja/ Shyam Gopal Bajaj and Ram Gopal Bajaj, both portrayed by Mr. Paresh Rawal, amplify the film's signature confusion driven plot.

37. It is submitted that the film contains several iconic dialogues and catchphrases that have, over time, acquired immense popularity and gained recognition. Due to their extensive use, they have become instantly recognizable and developed a strong secondary meaning in the minds of the public as being exclusively associated with the plaintiff's film. These include, "Aila", "Ouima", "Crime Master Gogo naam hai mera, aankhen nikaal ke gotiyan khelta hoon main!", "Yeh Teja Teja kya hai, Yeh Teja Teja?", "Teja main hoon, mark idhar hai", "Do dost ek pyale mein chai piyenge, isse dosti badhti hai", "Galti se mistake ho gaya," and "Aap purush hi nahi, mahapurush hain.". In addition to this, the signature catchphrases "Aila" and "Ouima" which are distinct to the characters of CS(COMM) 475/2025 Page 6 of 39 This is a digitally signed order.

38. The defendants are infringing the plaintiff's rights in the said film by displaying/communicating to the public/hosting/utilising content, creating merchandise, and online content related to the said film, which exclusively belongs to the plaintiff.

39. The defendants no.1 to 18 and defendants no.22 to 24 are selling merchandise bearing the intellectual property of the plaintiff in the said film. These products include t-shirts, hoodies, sweatshirts, mugs, notebooks, posters, badges, fridge magnets and digital art which inter alia featuring the name of the plaintiff's film 'Andaz Apna Apna', images and dialogues of characters from the plaintiff's film while also using the name of the characters/name of the film, i.e. Teja, Crime Master Gogo, Amar, Prem and Robert, as the product title. These products are being made available by the defendants through their websites, as well as third-party e-commerce platforms such as "Desert Cart", "Meesho", "Flipkart" and "Etsy", thereby reaching out to national and international customers as well, thus further diluting and tarnishing the value of the intellectual property of the plaintiff comprised in the said film.

40. It is the case of the plaintiff that the defendants are wrongfully trying to associate their infringing goods with the plaintiff's film. Given the likely inferior nature of these goods, there is a real threat of tarnishment and dilution of the plaintiff's intellectual property in the said film. Any objections to the quality of the defendants' products will be attributable to the plaintiff, as the public would have purchased such goods under the mistaken impression that they emanate from the plaintiff. 41. The defendant no.18 has registered the domain https://ailaouima.com, which is a signature phrase of the main characters of the film. It is submitted that the catchphrase is exclusively associated with the film, and defendant no.18 is infringing the same. The plaintiff discovered that upon entering the domain name https://ailaouima.com into a web browser which redirects to the defendant no.18's online storefront on Etsy (defendant no. 22). As already stated above, the infringing products sold by defendant no. 18 prominently feature the artwork, characters and other intellectual property of the plaintiff in the said film without any authorization which infringes the copyright and trademark rights of the plaintiff in such elements. 42. The defendant no. 12 runs a website called https://bobble.ai, generating digital stickers and artworks of characters and dialogues of the film. The stickers unlawfully utilize the likeness of the characters of the film along with popular dialogues from the film. 44. It is submitted that such unauthorized and rampant violations of plaintiff's copyright and trademark rights by the defendants are causing grave prejudice to the plaintiff. The illegal and infringing contents are easily and freely available and accessible across India, making it almost impossible for the plaintiff to take action against such websites in various jurisdictions. Such unauthorized dissemination not only undermines the rights of the plaintiff but also causes grave economic and personal harm to the plaintiff.

45. It is submitted that the defendants no. 12, 19 to 21 herein also are exploiting and misusing the plaintiff's intellectual property rights by using Artificial Intelligence-generated content such as videos and virtual stickers. This is especially so as the plaintiff has the right to commercialize the CS(COMM) 475/2025 Page 13 of 39 This is a digitally signed order.

It is contended that the actions of the defendants herein, with or without artificial intelligence, violate the sole right of the plaintiff to commercially exploit and earn revenue from its intellectual property and stand to cause irremediable harm to the plaintiff.

46. In the above-noted circumstances, the plaintiff has demonstrated a prima facie case for grant of an interim injunction in its favour, and in case ex-parte and interim injunction is not granted, the plaintiff will suffer an irreparable loss. Balance of convenience also lies in favour of the plaintiff and against the defendants.

47. Accordingly, till the next date of hearing, the following directions are issued:

i. An ex-parte ad-interim injunction is passed restraining the defendants no.1 to 16, 18 and 19 (including John Doe parties), their partners, proprietors, affiliates, officers, servants, agents, employees, and all other persons acting for and on their behalf or claiming under them, from in any manner hosting, streaming, making available for viewing or downloading, communicating to the public, or creating any content, including images, videos, audio-visual content, or AI-generated content which is identical to, adapted from, or derivative of the plaintiff's film "Andaz Apna Apna".

ii. An order of ex-parte ad-interim injunction is passed restraining the defendants no.1 to 16 18 and 19 (including John Doe parties), their affiliates, agents, representatives, assignees, group CS(COMM) 475/2025 Page 14 of 39 This is a digitally signed order.

(bearing registration numbers 5810194, 5810195, and 2345639) or any mark, name, label, designation, domain name, social media handle, storefront, hashtag, or meta-tag that is identical or deceptively similar thereto.

iii. An order for ex-parte ad-interim injunction is passed restraining the defendants no.1 to 16, 18 and 19 (including John Doe parties), their agents, affiliates, or any other persons acting through them, from passing off their goods or services, whether physical or digital, including merchandise, audio-visual content, images, or video as those of the plaintiff by misusing the plaintiff's film title, characters, or elements thereof, causing confusion, deception, or false association with the plaintiff.

iv. An order for ex-parte ad-interim injunction is passed restraining the defendants no.1 to 16, 18 and 19 (including John Doe parties), their affiliates, agents, representatives, or any other persons claiming under them, from engaging in unfair competition, misappropriation, tarnishment, and dilution of the plaintiff's trademarks and associated intellectual property by creating, publishing, hosting, streaming, selling, or offering any content or products under the name "Andaz Apna Apna" or any deceptively CS(COMM) 475/2025 Page 15 of 39 This is a digitally signed order.

The details of the infringing videos and merchandise, and other content that are advertised on the internet and which are required to be de- listed/taken down by the respective defendants as mentioned above, are provided in Annexure A-1 and Annexure A-2 of the present order.

vi. This injunction shall also operate in respect of the mirror/redirect/alphanumeric websites/URLs, which are put in play by defendants no. 1 to 16, 18 to grant access to the material being made available on the URLs in Annexure A-1 and Annexure A-2.

vii. Defendant no. 26 (Google LLC, owner of YouTube) is directed to forthwith take down, remove, and disable the infringing videos, shorts, or other content uploaded by defendants no. 19 to 21 infringing the plaintiff's rights which are hosted on the following URLs:
