This is repeat (third) bail application filed under Section 439 of Cr.P.C. for grant of bail to the applicant. Applicant has arrested on 16.07.2020 in connection with Crime No.1185/2020 registered at Police Station Kolar Road, District Bhopal (M.P.) for commission of offence punishable under Sections 498-A, 304-B & 34 of Indian Penal Code. His earlier bail applications were dismissed as withdrawn vide orders dated 07.12.2020 and 26.03.2021.
Counsel appearing for applicant submitted that applicant is husband of the deceased. There is allegation in the case diary that applicant used to beat the prosecutrix after consuming liquor. On some occasion he has beaten the prosecutrix over the family members. It is further submitted that there is no specific allegation regarding demand of dowry and harassment in connection of demand of dowry. Therefore, he prayed that bail application filed by applicant may be allowed.
Learned Panel Lawyer for the State opposed the application for grant of bail. He read over the statement of mother where allegations were made against the family members of the applicant in respect of demand of dowry. No specific allegation is made against the applicant that he demanded dowry from the family members of the deceased or did harassment of deceased in connection with demand of dowry. Panel Lawyer appearing for State also relied on the suicide note of deceased. He read over the suicide note, in suicide note also there is no allegation that applicant demanded dowry from the deceased or harassed her with demand of dowry.
Heard the arguments of counsel for both the parties.
Considering the facts and circumstances of the case, application filed by Signature applicant Not is allowed without expressing any opinion on the merits of the case. The applicant shall abide by the conditions prescribed under of Section 437 (3) of Cr. P. C. C.C. as per rules.
