The petitioner is an accused in connection with Rajmahal P.S. Case No. 16 of 2018, corresponding to G.R. No. 54 of 2018, for the offence punishable under sections 386 and 506/34 of the Indian Penal Code, pending in the Court of the learned S.D.J.M., Rajmahal.
Counsel for the petitioner submits that there is nothing against the petitioner. He submits that the petitioner has never demanded any amount as Rangdari nor he is involved in this case, which is apparent from the case diary and the F.I.R. itself. He submits that the petitioner is in custody since 26.04.2018. He submits that at the time of alleged occurrence the petitioner was in custody in other case. He lastly submits that the allegation of demanding Rangdari is false.
Addl. P.P. opposes the prayer for bail and submits that vide order dated 06.06.2018 the criminal antecedent report was called. Criminal antecedent report has been received, which suggests that there are 19 cases against the petitioner.
Counsel for the petitioner submits that in some cases the petitioner has already been acquitted, but he has not given the details.
Criminal antecedent report suggests that there are 19 cases against the petitioner out of which three cases are of West Bengal, one case is of Bihar. The cases are under sections 302, 385, 387, 395 and other allied sections of the Indian Penal Code.
In view of the criminal antecedent of the petitioner, I am not inclined to release the petitioner, namely, Prabhakar Mandal , on bail at this stage. Accordingly, this application is dismissed.
