Oral Order 03/ Dated :07.07.2022 The anticipatory bail application filed on behalf of petitioners, who are apprehending their arrest in connection with Complaint Case No. 90 of 2022 for the offence registered under Sections 41 and 42 of Indian Forest Act pending in the Court of learned Chief Judicial Magistrate, Koderma, is pressed into motion.
It is submitted by the learned counsel on behalf of the petitioners that petitioner no.1 is owner and petitioner no.2 is driver of the said truck from which the said seizure was made of 25 tone Quartz stone without any valid paper. It is further submitted that the petitioner no.1 is transporter and the seized goods were consignment.
Learned A.P.P. has opposed the prayer for bail. Considering the submissions made, the anticipatory bail application is allowed. Accordingly, the petitioners, above named, are directed to surrender before the learned Trial Court within a period of two weeks and in the event of their arrest or surrender, they shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties of the like amount each to the satisfaction of the Court below, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and the petitioner no.1 will deposit Rs.50,000/- and petitioner no.2 will deposit Rs.25,000/- in the Court below as security amount.
The petitioners will co-operate in the investigation and will appear under Section 41A Cr.P.C. as and when required and comply with the condition as laid down under Section 438(2) of the Cr.P.C.
