ORAL JUDGMENT
Date : 03-12-2021 Heard Mr. Sanjay Prasad, learned Advocate for the petitioner and Mr. Umesh Narayan Dubey for the respondents.
This petition has been filed for a direction to the respondents to make payment to the petitioner of his admitted dues with interest.
It has been submitted that the petitioner was entrusted with the task of completing the construction Patna High Court CWJC No.5539 of 2020 dt.03-12-2021 2/3 work of four classrooms in the school building of primary school, Mahapur under Mohara Block in the district of Gaya. The petitioner incidentally is the Headmaster of that school.
It has been submitted that despite the petitioner having completed the work, he has not been paid the money to which he is entitled. Even the Commissioner, Gaya has passed an order, according to the learned counsel for the petitioner, directing the District Education Officer, Gaya to make payment of the dues amount of the petitioner.
Several representations made by the petitioner before the Block Education Officer, Mohara, Gaya and District Programme Officer, Mass Education (Communication), Gaya has fallen on deaf ears.
Based on the aforesaid submissions made on behalf of the petitioner, this Court directs the petitioner to make a fresh representation before the respondent no. 6 within a period of four weeks, charting out in detail the Patna High Court CWJC No.5539 of 2020 dt.03-12-2021 3/3 amount to which he is entitled and on receipt of such representation, the respondent no. 6 shall pass a reasoned order within a further period of three months. If at all the petitioner is entitled to be paid, necessary sequel action shall be taken in that regard.
It goes without saying that respondent no. 6 shall first verify the entitlement of the petitioner and then pass any order.
With the aforesaid direction/observation, the writ petition is disposed off.
