1. In the present writ petitions, the petitioners, who are working as 23 Assistant Teacher (Panchayat) or Teacher (Panchayat) or Lecturer (Panchayat) have sought direction to the respondents to grant equal benefit of pension, GPF, House Rent Allowance, Medical Allowance, Stagnation Allowance and Dearness Allowance at par with the regular teachers of the Education Department as also the pay scale of the respective posts held by the regular teachers appointed in the School Education Department.
2. Similar prayer made by the petitioners has been negated by this Court vide order dated 30.1.2012 in WPS No.208/2012 (Rajeev Kumar Jaisawal & others Vs. State of Chhattisgarh & Others), against which Writ Appeal No.172/2012 was dismissed vide order dated 5.2.2013 by observing thus:-
"5.However, we make it clear that in case the Appellants are not being given salary as admissible under the statutory rules applicable to them, it would be open to them to file fresh writ petition after impleading concerned Panchayats."
3. In yet another matter of Smt. Gayatri Nirmalkar and others Vs. State of Chhattisgarh and others (WPS No.1974/2011), this Court by order dated 15.4.2011 dismissed the similar prayer, which was again taken to the Division Bench in Writ Appeal No.321/2011, which was disposed of reserving liberty in favour of the appellants therein to file representation before the Secretary, which shall be decided by a speaking order.

Nothing has been placed before this Court as to whether any such representation was preferred by any of the petitioners in two earlier writ petitions because if such representation has already been dismissed, the petitioners' cases will also be governed under the said order. However, for the present, the petitioners have placed reliance on two Single Bench orders passed in WPS No.4016/2011 (Afzal Ali & Others Vs. State of Chhattisgarh & Others), decided on 17.9.2015 and WPS No.4611/2016 (Smt. Omeshwari Dewangan & Others Vs. State of 24 Chhattisgarh & Others) decided on 8.9.2016 providing them opportunity to make representation akin to the order passed in Writ Appeal No.321/2011, referred to above.

Accordingly, the Writ Petitions are disposed of reserving liberty in favour of the petitioners to move representation before the concerned Secretary, who in turn shall decide the same by a speaking order. It is made clear that the Secretary shall consider the previous orders passed on the issue pursuant to the directions in the matters of Smt. Gayatri Nirmalkar and Rajeev Kumar Jaisawal, referred to above.
WPS 5497/20176. This matter pertains to the Department of Urban Administration as the petitioners are appointed as Assistant Teacher (Nagriya Nikay) and are claiming similar relief at par with regular Municipal Employees.
7. The present writ petition is also disposed of reserving liberty to the petitioners to make representation before the concerned Secretary who in turn shall decide the same in accordance with law.
