appellant and learned A.P.P.
This application has been preferred by the appellant for grant of bail to him during the pendency of this appeal.
The appellant has been convicted for the offences under Sections 302/34 and 201/34 IPC and has been sentenced to undergo imprisonment for life along with a fine of Rs. 5,000/- for the offence under Section 302/34 IPC.
It has been alleged that the accused persons including the present appellant had taken away the brother of the informant and subsequently in the next morning, the dead body of the brother of the informant was traced out.
Submission has been advanced by learned counsel for the appellant that there are no eye witnesses to the incident of murder. It has further been submitted that the main allegation has been levelled against Kallu @ Suraj Kumar Soni.
Learned A.P.P. has opposed the prayer for bail of the appellant.
It appears that P.W.3 and P.W.7 are the eye witnesses to the taking away of the deceased by the appellant and Kallu @ Suraj Kumar Soni as it is said that in a dance -1- program, these two accused persons were misbehaving with the females which was objected to by the deceased as a result of which he was taken away and subsequently in the next morning his dead body was found.
Regard being had to the strong circumstances which emanates from the evidence of the witnesses as noted above, we are not inclined to admit the appellant on bail. His prayer for bail is hereby rejected at this stage.
I.A. No. 16131 of 2025 stands rejected.
