1. Adv.Shri.B.B.Yenge present for appellants. Adv.Shri.S.T.Agrawal present for respondent No.1 & 3 to 5 and he filed purshis and he undertakes to file V.P. Adv.Shri.N.R.Nikam present for respondent No.6 and he filed purshis and undertakes to file V.P. The said advocates have waived notices of this Commission.
2. We have heard advocate of appellants and aforesaid respondents on the point of maintainability of the appeal as common appeal is filed by seven complaints in respect of common orders passed in seven complaints. It is submitted by advocate of appellants that appeal is maintainable as common order has been passed in respect of the seven complaints filed by seven complainants.
Advocates of aforesaid respondents submitted that merely because common order is passed in several complaints, single appeal against common order, is not maintainable. We also find that common appeal 5 F.A.No.: 83/2013 in respect of common order passed in seven complaints is not maintainable in law. Seven separate appeals ought to have been filed for order passed in respect of seven complaints. Hence following order is passed.
O R D E R
1. Appeal is rejected as it is not maintainable.
2. Appellants are at liberty to file separate seven appeals subject to period of limitation.
3. No order as to cost.
4. Copies of this order be issued to both the parties.
