Section 11 in THE CONSTITUTION (FORTY-THIRD AMENDMENT) ACT, 1977

11. Amendment of article 366.-

In article 366 of the Constitution, clause (4A) and clause (26A) shall be omitted.[The Constitution (Forty-Third Amendment) Act, 1977, repealed six articles (31D, 32A, 131A, 144A, 226A, and 228A) that had been inserted into the Constitution by the 42nd Amendment. These articles had given Parliament the authority to restrict legal union activity under the guise of preventing anti-national activity, thereby infringing on civil liberties. The repeal of Article 31D restores these civil liberties, and amends Articles 145, 228, and 366 to facilitate the omission of the six repealed articles.The elimination of Article 31D also restores legislative powers to the states, allowing them to address anti-national activity in a manner that upholds fundamental rights. Additionally, the judiciary has been restored to its proper place by the legislation. The Supreme Court will now have jurisdiction to declare state laws unlawful. This repeal marks an important step in the protection of civil liberties and the preservation of the constitutional balance between state and federal authority.Also Refer]
