UPON hearing the counsel the Court made the following
O R D E R
By our order dated 18.10.2013 we had asked learned counsel for the petitioner to take instructions whether charges had been framed against the respondents and if the same had not been framed, the reason for the delay. That order came to be passed in the light of the admitted position that the charge-sheet against the respondents had been filed by the CBI Court as early as in the year 2007 and we saw no reason why there should have been an inordinate delay in the framing of the charges against the accused persons. Learned counsel for the petitioners today submit on instructions that the matter is now coming up for framing of charges on 04.08.2014. An earlier communication dated 25.10.2013 which was placed on record before us from the Superintendent of Police, CBI Cochin addressed to the Commissioner of Central Excise and Customs however suggests that the CBI Court had found sufficient ground to frame charges against the accused persons and the said order of the CBI Court had been affirmed even by the High Court of Kerala. A copy of the order passed by the CBI Court or that passed by the High Court is not available on record. Be that as it may, we direct the Court of Special Judge, Ernakulam seized of the matter in question to submit a report as to the 3 current status of the case. The Court will explain whether charges have been framed against the accused persons and if they have not been so framed the reasons for delay in doing the needful. The report shall reach this Court within four weeks. Transmission by Fax is permitted.
