Heard learned counsel for the parties. After the arguments were heard, it was brought to the notice of the Court that the appellant – P. Sarangapani has already expired on 20.02.2019.

It may be noted that since the death of the appellant, there was no application filed by his legal representatives seeking Signature Not Verified permission to continue with the present appeal. Digitally signed by Deepak Guglani Date: 2023.09.01

Of course, the 12:08:12 IST Reason:

application for substituting them in place of the deceased- appellant has been filed alongwith an application seeking Crl.A. No. 2173/2011 condonation of delay of 1026 days in filing the application for substitution, nonetheless, there is no application seeking setting aside of the abatement, if any.
In any case, taking a lenient view in the matter, the application for substitution of the legal representatives of the deceased-appellant is treated as the application seeking permission to proceed/continue with the appeal, condoning the delay as prayed for.
The legal representatives of the deceased-appellant are permitted to proceed further with the appeal. Cause title of the appeal be amended accordingly.
Judgment is reserved.
