1. The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to include three advance increments on account of Ph.D. degree while calculating retiral benefits.

2. The petitioner claims that w.e.f. 17.11.2011, the petitioner was granted three advance increments on account of Ph.D. degree. He continued to receive those increments till the date of retirement. The respondent while calculating retiral dues has not included these increments in the salary. These increments were bound to be merged with the pay.

3. Mr. P.P. Singh, Advocate for the petitioner submits that as per applicable instructions, respondent is bound to include advance increments in the salary while calculating retiral dues. The petitioner has filed representation before the authorities but to no avail.

4. Notice of motion.

5. Ms. Sukhmani Patwalia, Advocate who on advance notice is present in Court, accepts notice on behalf of respondents No.1 & 2 and waives service.

6. With consent of learned counsel for the parties, the case is taken up for final disposal.

7. Learned counsel for respondents No.1 and 2 submits that Competent Authority would look into grievance of the petitioner and pass an appropriate order within 2 months from today.

8. In the wake of statement of learned counsel for respondents No.1 & 2, the present petition stands disposed of.
