                               Heard Mr. D.R. Galande, learned counsel for the
                  applicant, and Ms. Deepali Sapkal, learned APP for the
                  non-applicant/State.

                  2.           The present applicant has approached this Court
                  apprehending his arrest in the event of registration of FIR
                  against him and other accused persons, based on a complaint
                  lodged on 16th October, 2025 by one Ravindra Pandharinath
                  Wagh, along with seven other persons, at Police Station
                  Buldhana.        Pursuant       to     the       said    complaint,   the
                  respondent-Police Station issued a notice to the present
                  applicant and other proposed co-accused on 29th October,
                  2025, which is placed on record at page No.21 (Annexure-2).


                  3.           Apprehending the arrest, the present applicant, along
                  with the other persons named in the said notice, approached
                  the       learned         Sessions         Court,        Buldhana     on
                  6th November, 2025, by filing an application under Section 482

               of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking grant
               of anticipatory bail. The learned Sessions Court, vide its order
               dated 29th November, 2025, passed in Criminal Application
               No.422 of 2025, allowed the said application so far as applicant
               Nos.1 and 4 therein are concerned and granted them
               anticipatory bail. However, the application filed by the present
               applicant came to be rejected. While rejecting the application of
               the present applicant, the learned Sessions Court observed that
               the present applicant had acted as a designated partner, had
               entered into various activities, and therefore was an active
               partner along with proposed accused No.1, namely Pushpanjali,
               and on that ground rejected his application.


               4.        Mr. Galande, learned counsel for the applicant, has
               pointed out that though the learned Sessions Court has
               observed in its order that the present applicant is an active
               partner in Pushpanjali Venture LLP, the present applicant was
               inducted as a partner in the said LLP only on 06.09.2024, i.e.,
               after the death of the husband of Mrs. Pushpanjali. The sole
               purpose of his induction as a partner was to keep the said LLP
               in existence. The present applicant holds only 1% share in the
               profit-sharing ratio of the said LLP, which clearly demonstrates
               that he is merely a nominal partner. He was included in the LLP
               at the request of his sister solely to ensure the continuity of the
               LLP.

               5.        It is further submitted that the entire allegations in
               the complaint dated 16.10.2025 reveal that Pushpanjali had
               entered     into    an     agreement      with     the      various
               complainants/objectors. All payment transactions were carried

               out in accordance with the agreement entered into by her, and
               the amounts were paid to her.

               6.         In view of the above, I am inclined to grant
               ad-interim protection to the present applicant for a period of
               one week, i.e., till the returnable date of 5th January, 2026,
               subject to the condition that the applicant shall co-operate with
               the respondent-Police Station during the enquiry. Hence, I
               proceed to pass the following order:


                                          ORDER

i) In the event of registration of crime and the arrest of the present applicant, Bharat S/o. Shrikishna Patil, in connection with the complaint lodged by the complainants at the Police Station Buldhana City, Buldhana, which is at record page No.14 (Annexure-1), he be released on ad-interim anticipatory bail on his furnishing P.R. bond in the sum of Rs.25,000/- with one surety in the like amount.

ii) The applicant shall attend the concerned police station on 29th December, 2025, 31st December, 2025, and 2nd January, 2026 between 11.00 a.m. and 2:00 p.m. and shall co-operate with the investigating agency.

iii) The applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade them from disclosing such facts to the Court or to any police officer.

iv) The applicant shall submit a list of at least 3 blood relatives with their detail residential addresses and also the addresses of their place of work, if any and documentary proof of showing the correctness of the details produced by them.

v) The applicant shall submit copies of at least two documents amongst the Passport, PAN Card, Aadhar Card, Ration Card, Electricity Bill or Voter Identity Card issued by the Election Commission of India.

vi) The applicant shall not pressurize or give threat in any manner to the witnesses.

vii) The applicant shall not establish any contact with the complainant or the prosecution witnesses.

7. Issue notice to the non-applicant, returnable on 5th January, 2026.

8. Ms. Deepali Sapkal, learned APP, waives service of notice on behalf of the non-applicant/State.

9. All concerned to act upon the authenticated/uploaded copy of this order.
