UPON hearing the counsel the Court made the following
O R D E R
Heard.
We see no reason to interfere with the impugned order. The special leave petition is accordingly dismissed.
The petitioner-tenant is however granted time till 30th September, 2015 to vacate and hand over peaceful possession of the suit premises to the respondent, subject to the following conditions:
(1) The petitioner files in this Court an Signature Not Verified Digitally signed by undertaking on usual terms within four weeks from Mahabir Singh Date: 2015.04.07 16:59:24 IST today.Reason:
(2) The petitioner deposits with the trial court or pays directly to the respondent, compensation for use/occupation of the premises 2 in-question at the rate of Rs.10,000/- (Rupees ten thousand) per month w.e.f. 1st April, 2015 till the date the premises is actually vacated.
The deposit shall be made by the 10 th of every succeeding calender month. The compensation for the month of April 2015 shall be deposited/made by the 10th May, 2015.
(3) Arrears of rent, if any, at the rate of Rs.2400/- (Rupees two thousand four hundred) per month shall also be paid/deposited by the petitioner within two months from today.
(4) The amount so deposited shall be released in favour of the respondent.
(5) In the event of default or breach of any of the conditions stipulated above the eviction order shall become executable forthwith.
