Section 14(2)(a) in The Bihar Evacuee Property (Management) Act 1953

(a)where the mutawalli is an evacuee, the property forming the subject-matter of the waqf shall vest in the Committee, subject to rights and interests of such of the beneficiaries as are not evacuee ;
