Bail Appln.1881/2021

1. This application under Section 438 Cr.P.C. is for grant of anticipatory bail in the event of arrest in FIR No.108/2021 dated 22.04.2021 registered at Police Station Delhi Cantt., for offences punishable under Sections 392/188/269/34 IPC.

2. Mr. Rajiv Mohan, learned counsel appearing for the petitioner states that the petitioner is contesting elections for the Shiromani Gurdwara Parbandhak Committee (SGPC) from Chander Vihar constituency. Learned counsel for the petitioner states that accused Gurumukh Singh is a supporter of the petitioner and being a supporter, the petitioner was in regular touch with the accused. He states that this itself does not indicate that the petitioner was a party to the alleged offence. He further states that the petitioner was not in the vicinity when the offence was committed and he Bail Appln.1881/2021 Page 1 of 2 was also not in touch with accused Gurumukh Singh when the offence was committed. Learned counsel for the petitioner states that the petitioner had been given protection from arrest by an order dated 30.04.2021 passed by learned Trial Court.

3. Ms. Meenakshi Chauhan, learned APP for the State opposes the submissions made by the learned counsel of the petitioner and states that two co-accused have been arrested and they have given their disclosure statement implicating the petitioner.

4. Issue notice.

5. Ms. Meenakshi Chauhan, learned APP appearing for the State accepts notice and seeks time to file a status report. The status report be filed before the next date.

6. The status report shall indicate the location of the petitioner at the time when the alleged offence was committed and the time when the petitioner contacted the co-accused Mr. Gurumukh Singh.

7. Let the disclosure statements of the co-accused be filed in a sealed cover and submitted to the Court Master separately.

8. Needless to say, the status report without the enclosures be supplied to the learned counsel for the petitioner.

9. List on 04.06.2021.
