COMMON JUDGMENT:(PerHon'ble Sri Justice Tariada Rajasekhar Rad) W.A.No.29 of 2024 is taken as lead appeal for disposal of the present batch of Writ Appeals.
Heard the learned Government Pleader for Services-I, for the appellants and also heard Sri M.Srikanth, learned counsel appearing for the respondents-writ petitioners.

A batch of Writ Petitions were filed before a learned Single Judge of this Court seeking a declaration that the respondents' action in denying relief comparable to that of similarly situated employees in G.O.Ms.No.179, School Education (Prog.I) Department dated 18.11.2022, is unlawful, capricious, and discriminatory, violative of Articles 14, 16, and 300A of the Constitution of India and consequentially to direct the respondents to treat the past services rendered prior to their regularisation for the purpose of pension and pensionary benefits.
3. Precisely, the Writ Petitions were filed to direct the respondents to grant the same relief, i.e., to extend pension-related benefits retrospectively on par with other employees. A learned Single Judge of this Court, taking note of the orders of the Tribunal in O.A.No.2889 of 2015 dated 27.04.2017, and the order of the Hon'ble Supreme Court dismissing SLP (Civil Appeal) No. 7474 of 2020, dated 08.02.2021, pref^^red against W.P.No.1425 of 2019, held that the petitioners herein 2 are also entitled to the same relief, on par with the persons covered under G.O.Ms.No.179, dated 18.11.2022.

Background of the case is that a good number of vocational instructors were appointed through a regular selection process on part time basis during the period 1985-1991 in different dates and through employment exchange in various districts and they have put up their services of about 25 to 30 years. During their tenure as Vocational Instructors, the Government sanctioned around 1,030 posts for this role. However, the requests from the applicants seeking accommodation in those posts were not considered by the Government.. Consequently, the applicants approached the Andhra Pradesh Administrative Tribunal under Section 19 of the A.P. Administrative Tribunal Act, filing several original applications (O.A.s), including O.A. No. 2889 of 2015. The Tribunal ultimately granted relief, ordering the respondents to regularise the services of the applicants who approached the Tribunal. Accordingly, the Government, vide G.O.Ms.No.31 dated 13.02.2009, regularised the services of 1030 Vocational Instructors with effect from 13.02.2009 and the writ petitioners are also among them.

While the matter stood thus, some other applicants who are nearing to retirement having put up sufficient part time service have submitted representations to the respondents to recognise their services rendered temporarily for the purpose of pension and pension related benefits. Due to the respondents' failure to consider this, those applicants have filed O.A.No.8904 of 2011 with the Administrative Tribunal, seeking a directive for the recognition of their prior service in relation to pension benefits.

The Government/State has filed counter and stated that the employees cannot be accorded notional seniority and further the orders of regularisation were issued on 13.02.2009, as such, they are entitled for counting of their services from the date of G.O.. but not from the earlier date. The Tribunal after considering the judgments of the Apex Court and the orders of the erstwhile High Court of Andhra Pradesh has allowed all the O.As. filed by the employees vide orders dated 27.04.2017 and held that the employees are entitled for counting their services rendered prior to their regularisation for the purpose of pension. Out of the several O.As., the State has filed Writ Petition in W.P.No.1425 of 2019 against O.A.No.2889 of 2015 and the same was dismissed by a Coordinate Bench of this Court, vide orders dated 15.10.2019.
7. Subsequently, the government issued G.O.Ms.No.l79 from the School Education (Prog.l) Department on November 18, 2022, recognizing past service for the purposes of pension and related benefits.
8. Subsequent to the allowing of the batch of O.As in O.A.No.2889 of 2015., the writ petitioners in W.P.No.9381 of 2023 and batch filed O.A.No.2909 of 2017 seeking the similar relief granted in O.A.No.2889 of 2017 to regularise their service. The said O.A. was allowed vide orders dated 30.10.2017.
9. The present writ petitioners have filed W.P.No.9381 of 2023 and batch. On .repetition, this Court has allowed the said batch of Writ Petitions, vide orders dated 11,05.2023, directing the respondents to 4 consider the claim of the petitioners in pursuance of the orders of this Court as well as G.O.Ms.No.179 dated 18.11.2022 and to treat the past service rendered prior to their regularisation for the purpose of pension related benefits. Assailing the same, the present batch of Writ Appeals are filed.
10. It is pertinent to state that Original Applications filed by the writ petitioners were allowed on 30.10.2017 by the Andhra Pradesh Administrative Tribunal following the earlier order of the same Tribunal dated 27.04.2017 in O.A. No.2889 of 2015 and batch.
11. Aggrieved by the orders in the batch of O.A.No.2889 of 2015 the State has preferred Writ Petitions before the High Court of A.P., in W.P.No.1425 of 2019. A Co-ordinate Bench of this Court has dismissed the Writ Petitions, vide order dated 15.10.2019. placing reliance on the judgments of the Apex Court in State of Tamilnadu Vs. T.N.Registration Department Ministerial Services Association reported in (2001) 10 SCC 473 and (2) State of Andhra Pradesh Vs. M.Raja Rao (order dated 17.03.2016 in W.P.No.8201 of 2016) and the order of Karnataka High Court in B.H.Mahadevappa Vs. Karnataka Power Transmission Corporation Limited reported in Manu/K.A./8167/2006. The Division Bench has framed the an issue as to whether the past, services of the applicants in O.As. i.e., prior to their regularisation can be taken into ■ consideration for the purpose of pensions? And answered the query in the following.
"In view of the Judgments of the Apex court and other high courts referred above, we are of the view that the past services of the applicants who is the respondent herein, prior 5 to his regularisation has to be considered for the purpose of pensionary benefits."
12. It is also pertinent to be note here that once the orders of the Tribunal are not challenged and have become final, there is no other option for the authorities except to implement the same.
13. ■ The order dated 15.10.2019 in W.P.No.1425 of 2019 was challenged by the State in SPECIAL LEAVE PETITION (CIVIL) Diary No(s) 7474 / 2020. The Apex Court was not inclined to interfere with the order of the High Court and the Special Leave Petition was dismissed vide order dated 08.02.2021.

Some of the employees (recognised teachers) have filed W.P.Nos.973 & 975 of 2020 and batch seeking a prayer to direct the respondents to implement the common orders passed by the APAT in batch of Original Applications under Section 19 of the Administrative Tribunals Act, 1995. A Coordinate Bench of this High Court, vide order dated 20.01.2020 has directed the respondents to implement the orders of thfe APAT in O.A.Nos.2889 of 2025 and batch.

The learned Government Pleader argues that the writ petitioners cannot maintain the present Writ Petitions on two grounds: (1) that the writ petitioners have approached this Court belatedly and laches apply and (2) while disposing the i.A. 2 of 2024 filed for suspension of the order of the learned single Judge, this Court vide order dated 28.10.2024 directed the writ petitioners to make a representation to 6 authorities, the authorities were asked to consider the same in accordance with law and the said representation was rejected by the respondents authorities, since they rejected the representation, this provides a new or fresh cause of action, hence pleaded to direct the writ petitioners to initiate appropriate legal proceedings against the rejection order.
16. It is the grief or grievance of the writ petitioners that based on the said G.O.Ms.No.179 other employees or vocational teachers were regularized from the date of their appointment with retrospective effect for the purpose of pension and related benefits. However, the same treatment was not extended to the writ petitioners, even though their ' services were regularized on par with other employees as per G.O.Ms.No.31 dated 13.02.2009.
17. The Hon'ble Apex Court has also dismissed the SLP (CIVIL) Diary No(s) 7474 / 2020 vide order dated 08.02.2021 filed against the order in W.P.No.1425 of 2019. Following the order in the said Writ Petition, a Coordinate Bench of this Court in W.P.Nos.973, 1036 of 2020 and batch dated 20.01.2020, granted the same similar relief, i.e., to consider past service for the purpose of pensionary benefits.
18. This Court refers to the decision of the Hon'ble Supreme Court reported in State of Uttar Pradesh v. Arvind Kumar Srivastava [2015(1) see 347]. Paragraph 23 of the said decision reads thus;-
(1) Normal rule is that when a particular set of employees is given relief by the Court, all other identically situated persons need to be treated alike by extending that benefit. Not doing so would amount to discrimination and would be violative of Article 14 of the Constitution of India. This principle needs to be applied in service matters more emphatically as the service jurisprudence evolved by this Court form time to time postulates that all similarly situated persons should be treated similarly. Therefore, the normal rule would be merely because other similarly situated persons did not approach the Court earlier, they are not to be treated differently. (2) however, this principle is subject to well recognized exceptions in the form of laches and delays as well as acquiescence.

In the judgment of the Apex Court the employee therein or the affected persons have approached the Court after 9 years and in the present the case the writ petitioners are not able to approach the curt as the tribunal have abolished and the writ petitioners are in uncertainty about invoking of the jurisdiction. And it is also to be understood that the Administrative Tribunal has granted the relief now the writ petitions are seeking implement the orders of the Tribunal on par with other employees. The tribunal has granted the order of regularisation on par with other employees. With such a pronouncement, the obligation is cast upon the authorities to itself extend the benefit thereof to all similarly situated persons.

Later, the Tribunal was abolished, and the respondents implemented its orders in the case of other employees by granting them pension and regularizing their services from the date of their initial appointment (i.e., retrospectively) and the present writ petitions have 8 been filed to implement the G.O.Ms. No. 179 dated 18.11.2022 which was implemented to other same/similarly situated persons.
21. The Hon'ble Supreme Court in The State of Gujarat & Ors., Vs. Talsibhai Dhanjibhai Patelin (SLP(C).No.l 109/2022) dated 18.02.2022, opined as follows;
"It is unfortunate that the State continued to take the services of the respondent as an ad-hoc for 30 years and thereafter now to contend that as the services rendered by the Respondents are ad-hoc, he is not entitled to pension/pensionary benefit. The State cannot be permitted to take the benefit of its own wrong. To take the Services continuously for 30 years and thereafter to contend that an employee who has rendered 30 years continues service shall not be eligible for pension is siouiiiiy oui LssjiedSuiiduie. /-\s a welfare State, the State as such ought not to have taken such a stand."

When the writ appeal is listed before another Division Bench while considering the interlocutory application seeking suspension of the order of the learned Single Judge in I.A.No.2 of 2024, the Bench has directed the writ petitioners to submit a representation to the authorities to examine in the line with Supreme Court judgments in the case of Lima Devi and Manjulabashini. It is important to note that this does not constitute a final order for the application of the merger theory to assail the rejection order of the authority.

23. In Dr. A.R. Sircar Vs. State of U.P. & Ors., (1993) Supp. 2 SCC 734, the dispute arose regarding the seniority of direct recruits and promotees on the post of Professor of Medicine in a medical college. The appellant therein faced the selection process for direct appointment along with the respondents who had been working on the said post on ad hoc basis. The appellant was duly selected, however, the private respondents could not succeed. The respondents filed the writ petition before the High Court and precluded the appointment of appellant pursuant to his selection, by obtaining the interim order and on the other hand they got their ad hoc promotion to the post regularized under the rules. The appellant could succeed in obtaining the appointment only after dismissal of the writ petition against him after several years of his selection. The Apex Court held that in addition to the relief under the statutory provisions the appellant was entitled in equity to get the seniority over the respondents as they succeeded in precluding his appointment to the post by obtaining an interim order in a case having no merits whatsoever.

If the order of the Hon'ble Apex Court is understood in proper perspective, the direction to dispose of the representation and rejection of the representation preclude the relief claimed by the writ petitioners and the rejection order by the respondents having no bearing to disposal of the appeal on merits.

On analysing the judgment of the Apex Court and considering the proceedings, we found no reasons or flaw in the order of the learned Single Judge. The learned Single Judge after considering the judgments rendered by the Coordinate Bench of this Court and 10 # dismissal of SLP (Civil Appeal) No.7474 of 2020, has allowed the Writ ■ Petitions. The petitioners are also entitled for the same relief on par with the other similar employees listed in G.O.Ms.No.179 dated 18.11.2022.
26. Accordingly, all the Writ Appeals are dismissed. No costs. As a sequel, interlocutory applications pending, if any, in these cases shall stand closed.
