FACTS:

2. The appellant filed the RTI application seeking copy of audit report for period 1.4.1990  to 31.3.2015 of Ghalib Memorial Apartment along with copy of file of arbitration.   The CPIO  said that they do can't give information as it is fiduciary information. The appellant filed appeal  before the first appellate authority (FAA). FAA did not respond. Dissatisfied, the appellant filed  a second appeal before this Commission under section 19(3) of the RTI Act.

Proceedings Before the Commission:

3. Advocate stated that audit report sought by the appellant was submitted to the RCS,  which he can obtain from RCS. There were litigations between society and DCHFC. Counsel  of   DCHFC   Limited   stated   that   the   defaulter   societies   did   not   file   their   audit   reports   with  DCHFC, they might have filed the same before RCS. He also stated that they are not holding  the audit report, and that entire file along with audit reports were submitted to RCS.

4. The Commission considers the President/Secretary of the society as deemed PIOs  and directs them to furnish certified copy of audit report sought by the appellant within one  month. The Commission orders accordingly.
