1. The dispute is qua the date of filing of petition under Section 34 of the Arbitration and Conciliation Act, 1996 by the petitioner herein. The award was passed on 19.05.2022; thereafter an application under Section 33 of the Arbitration and Conciliation Act, 1996 was filed, which was decided on 23.09.2022. The 90 days limitation for filing application under Section 34 of the Arbitration and Conciliation Act, 1996 expired on 21.12.2022.
2. It is the submission of the learned counsel for respondent, this petition under Section 34 of the Arbitration and Conciliation Act, 1996 was filed on 09.01.2023 as admitted by petitioner in its reply to petition filed by respondent herein under Section 34 of the Arbitration and Conciliation Act, This is a digitally signed order.
