Heard Mr. M.C. Pant, Advocate with Mr. T.C. Pandey, Mr. H.C. Joshi, Mr. D.K. Joshi and Mr. Sanjay Bhatt, Advocates present for the petitioners and Mr. Subhash Upadhyay, learned Chief Standing Counsel assisted by Mr. N.P. Sah, Standing Counsel present for the State/respondents.

By means of these writ petitions, daily rated workers in the Forest department have challenged the direct recruitments to Class IV posts being made by the Forest Department.

The contention of learned counsel for the petitioners is that till their services are regularised in accordance with law, the State Government cannot fill the vacancies by way of direct recruitment. Meanwhile, since a statement has been made in this Court by learned Chief Standing Counsel Mr. Upadhyay that State has already taken a 3 decision not to fill the posts which have to be filled from amongst the petitioners, such posts will not be filled by this direct recruitment.

Petitioners on the other hand contented that they are liable to be regularised on all the existing vacancies.

In view thereof, in the interest of justice, the present on going selection process of direct recruitment shall remain stayed in order to resolve the controversy till the next date of listing.

List these petitions on 19.11.2014 in the daily cause list for final disposal.
