O R D E R:

- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) With the consent of the learned counsel for both the parties, this writ petition is taken up for disposal at the admission stage.

The writ petition is filed challenging the order dated 02.04.2018 in O.A.No. 411 of 2018 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, whereby, the Tribunal, while disposing of the application filed by the petitioner under Section 19 of the Administrative Tribunals Act, 1985, directed the 1st respondent to appoint fresh enquiry officer in place of Dr.Premchand as expeditiously as possible and preferably within a period of six weeks from the date of receipt of a copy of the order.

It is not in dispute that Charge Memo was issued by the Government against the petitioner on 31.07.2013, however till date there has been no progress in the departmental enquiry. Moreover, the petitioner retired from service on 30.09.2013 and Dr.Premchand, the Enquiry Officer, resigned on 31.01.2018.

Keeping in view the fact that Charge Memo was issued on 31.07.2013 i.e. five years ago, and in the light of the facts SKK,J & AKS,J 2 WP_20872_2018 and circumstances of the case, we hereby direct the respondents to conclude departmental proceedings within a period of three months from today, failing which, Charge Memo dated 31.07.2013 shall stand quashed.

With the above direction, the writ petition is disposed of at the admission stage. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
