Petition under Section 151 of CPC, praying that in the circumstances
stated in the affidavit filed herein, the High Court may be pleased to pass
an order to stay of all the further proceedings in the MVOP No.13/2015 on
the file of the Hon'ble Chairman, Motor Accident Claims Tribunal-cum-XIil}
Addl. District Judge, Gajuwaka,Visakhapatnam District including that of
withdrawal of amount if any deposited, pending disposal of MACMA.No. 441
of 2022 on the file of the High Court.
The Court while directing issue of notice to the Respondents herein to
show cause as to why this petition should not be complied with, made the
following order. (The receipt of this order will be deemed to be the receipt
of notice in the case).
ORDER:-
"Heard learned counsel for the petitioner-appellant.
As the issues raised for consideration in the grounds of appeai require a detailed examination, there shall be interim stay as prayed for, on condition of the petitioner - appellant depositing 50% of the compensation awarded along with proportionate interest and costs, to the credit of MVOP.No.13 of 2015 on the file of the Motor Accidents Claims Tribunal cum-xlll Additional District Judge at Gajuwaka, within a period of six weeks from the date of receipt of a copy of this order."
