ORAL JUDGMENT
(Per: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI) Date: 21-02-2017 I.A. No. 7967 of 2013 has been filed for condonation of delay of 11 days in filing the Letters Patent Appeal.
2. For the reasons mentioned in the Interlocutory Application, the delay in filing the present Letters Patent Appeal is condoned. I.A. No. 7967 of 2013 is, accordingly, allowed.
Re : L.P.A. No. 1421 of 2013.
3. The challenge in the present Letters Patent Appeal is to an order dated 07.08.2013 passed by the learned Single Judge in M.J.C. No. 3258 of 2011 arising out of C.W.J.C. No. 5410 of 2007 whereby the contempt application has been dismissed with cost of Patna High Court LPA No.1421 of 2013 dt.21-02-2017 3/3 Rs.500/- against each of the petitioner which Civil Surgeon-cum- Chief Medical Officer, Siwan shall realize from them in accordance with law.
4. The present Letters Patent Appeal is dismissed as the same is not maintainable in view of the law settled by the Hon'ble Supreme Court in the case of D.N. Taneja Vs. Sri Bhajan Lal reported in (1988) 3 SCC, 26.
