UPON hearing the counsel the Court made the following
O R D E R
Heard learned counsel for the parties.
In Writ petition No. 4076 of 2018, the High Court by its order dated 09.04.2018 has directed that in case the dealership of Signature Not Verified respondent no. 1 is terminated by the Indian Oil Corporation, the Digitally signed by MAHABIR SINGH Date: 2018.10.30 17:17:42 IST Reason: same shall not be given effect for a period of two weeks so that appropriate remedy may be availed by the petitioner in accordance 2 with law. The High Court has also, inter alia, in para 4 of the impugned order directed “3 dispensers are allowed to be run”. When the matter came up for hearing by order dated 25.09.2018, this Court has granted stay of the impugned order.
Learned counsel appearing for respondent no. 1 has filed this application stating that the dealership of respondent no. 1 has been terminated on 9th October,2018 which came to be served to respondent no. 1 on 11.10.2018. In the application, it is also stated that first respondent has challenged the same in Civil writ Petition No. 11808 of 2018 before the High Court. Since the dealership of respondent no. 1 has been challenged, the parties shall work out their remedy in the Writ Petition filed by respondent no. 1 before the High Court. All the contentions of the parties are kept open.
The special leave petition is, accordingly disposed of. Pending application(s), if any, shall also stand disposed of.
