43. Payment of penalty.
- A person who, either by himself or at the instance of any and other person, commences, undertakes or carries out development of, or change the use of, any land without obtaining certificate regarding development charge or betterment charge under section 80, the Authority may serve on such person a notice requiring him to pay the development charge or betterment charge, as the case may be, and also a penalty at the rate of eighteen per cent per annum of the amount due from him payable from the date of default upto the date it is actually paid.
