02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is an accused in G.R. Case No.651 of 2022 pending on the file of learned J.M.F.C., Aska, arising out of Dharakote P.S. Case No.141 of 2022.

3. Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. Sessions Judge, Aska by order dated 13.10.2022 in the aforementioned case, the present BLAPL has been filed.

4. It is submitted by the learned counsel that the charge sheet has already been submitted under Sections 498-A/304-B/306/506/34 IPC and Section 4 of the D.P Act and as the Petitioner is in custody since 8.6.2022, he may be released on bail.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the materials on record and the post-mortem report which indicates that there are no external injuries, this Court Page 1 of 2 directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin.

7. Accordingly, the BLAPL stands disposed of.

8. Urgent certified copy of this order be granted as per rule.
