By Hon'ble Mrs. Harvinder Kaur Oberoi, Member (J) The applicants, 78 in number, have filed this OA seeking the following relief:-
""1. To quash and set aside the impugned orders dated 11.03.2024 and 20.03.2024.
2. To direct the Respondents to regularize the services of Applicants as Domestic Breeding Checkers or MTS (PH) or any other equivalent post from the date of initial appointment by granting arrears as well as with all consequential benefits as done in case of Entomologists.
3. To declare the action of Respondents in not regularizing the services of petitioners as Domestic Breeding Checkers or MTS (PH) or any other equivalent post from the date of initial date of appointment as illegal and arbitrary and direct the Respondents to regularize the services of applicants by following the order dated 29.09.2015 of Hon'ble Tribunal in TA No. 352/2009 upheld by the Hon'ble Delhi High Court and Hon'ble Supreme Court by disposing off Civil Appeal No. 8974 of 2019 vide order dated 22.11.2019 and give all consequential benefits by following the same criteria as followed in case of Entomologist.
4. Pass any other such order as the Hon'ble Tribunal may deem appropriate."

Learned counsel for the applicants submits that applicants have been continuously engaged as Domestic Breeding Checkers (DBCs) on contractual basis for several years under the respondents' department. Despite long service, their engagements have not been 13 Item No. 06 (C-4) O.A. No. 3176/2025 regularized. They seek parity with similarly placed persons whose services were regularized pursuant to the order of this Tribunal in TA No. 352/2009 decided on 29.09.2015, which was upheld by the Hon'ble Delhi High Court and affirmed by the Hon'ble Supreme Court in Civil Appeal No. 8974/2019.
3. It is contended that the respondents' action in denying regularization to the applicants, while granting the same to Entomologists, is arbitrary and discriminatory. He submits that the applicants be regularized as DBCs or, in the alternative, as MTS (PH) or any equivalent post, with all consequential benefits
4. Learned counsel submits that this Tribunal had occasion to consider the identical issue in TA No. 352/2009 and by order dated 29.09.2015 directed the regularization of similarly placed employees. The said order was challenged by the respondents before the Hon'ble High Court of Delhi in W.P.(C) 11856/2022 but the writ petition came to be dismissed. Ultimately, the matter reached the Hon'ble Supreme Court in Civil Appeal No. 8974/2019, North DMC v. Satish Kumar & Ors. where also the claim of the employees was upheld and the appeal was dismissed vide order dated 22.11.2019. The respondents thereafter regularized the services of Entomologists on the strength of these directions.
5. It is further urged that the Hon'ble Supreme Court in State of Karnataka v. Umadevi (2006) 4 SCC 1 14 Item No. 06 (C-4) O.A. No. 3176/2025 carved out an exception that where irregular appointees have worked for long periods against sanctioned posts, a one-time measure of regularization can be undertaken. The applicants clearly fall within this protective principle.
6. Ms. Anupama Bansal, appears on behalf of the respondents on advance service. She opposes the OA and submits that the applicants have no enforceable right to seek regularization in the manner claimed. The relief sought is misconceived for the simple reason that the permanent post of Domestic Breeding Checker (DBC), on which the applicants claim regularization, does not exist in the present establishment. The scheme(s), if any, under which any such engagements were earlier made has been discontinued, and there is no sanctioned post of DBC available for regularization.
7. Counsel further submits that the applicants themselves have not sought appointment as Multi- Tasking Staff (MTS). Even otherwise, the applicants do not possess prior experience of duties attached to MTS, and therefore cannot be considered as eligible for direct absorption in that cadre.

It is also pointed out that the judgments relied upon by the applicants, namely TA No. 352/2009 and subsequent decisions of the Hon'ble High Court and Supreme Court, pertain specifically to employees working as DBCs at the relevant point of time when such posts existed. It was in those circumstances that 15 Item No. 06 (C-4) O.A. No. 3176/2025 relief was granted to the petitioners therein. Since the very basis of those judgments is absent today, the same cannot be invoked by the present applicants.
9. We have considered the matter. The claim of the applicants rests on their service as casual DBCs and they seek regularization. Admittedly no sanctioned post of DBC exists since the same has been merged in cadre of MTS. Applicants were never engaged as casual MTS. In the aforesaid facts, the judgments relied upon are not applicable and no right of regularization can be claimed in respect of a non-existent post.
10. Accordingly, the OA is dismissed at the admission stage itself. However, the applicants are at liberty to make a fresh, specific representation before the respondents, which may be examined in accordance with law. Pending MAs, if any, also stand dismissed. No costs.
