(16-12-2021) Per: Ravi Malimath, Chief Justice This petition is filed with the following prayers :-

(i) That the Hon'ble Court be pleased to quash the departmental enquiry being conducted by the respondent.
(ii) Any other relief which this Hon'ble Court deems fit and proper on the facts and circumstances of the case be passed.

Learned counsel appearing for the respondents places the order dated 24.01.2005 passed by this Court in W.P. No.3350 of 1999 pertaining to the very same writ petitioner.

In the said petition, a challenge was made to the order passed by the Disciplinary Authority compulsorily retiring him from service. By the said order, the writ petition was allowed in part. The matter was remitted to the Appellate Authority to consider all facets raised in the appeal including the issue relating to proportionality of punishment. Subsequently, by the order 23.03.2006, the aforesaid order was upheld and his compulsory retirement was continued. In the interregnum, the instant writ petition was filed seeking to challenge the departmental proceedings.

In view of the departmental proceedings having been concluded in 2 WP-6971-2000 W.P. No.3350 of 1999, nothing else can be done in the instant petition. Hence, we find no good ground to proceed further in this matter.

Accordingly, the writ petition is dismissed.

Pending interlocutory applications, if any, are also disposed off.
