   01.       1.     Heard learned counsel for the Parties.

2. There is serious grievance by the Petitioners that undisputedly Petitioners family have dedicated their own land for construction of the road in front of the Petitioners house particularly keeping in view that Government was unable to arrange land for the purpose. It is alleged that after the construction of road still there is some land remain unutilized from the donated land left out. It is alleged instead of returning surplus land or utilizing the same for useful purposes, there is an attempt by Municipal Authority in undertaking the exercise of construction of vending zone thereby attempting to completely obstruct the passage of the Petitioners to their own land.

3. It is at this stage of the matter this Court finds, Petitioners have already a detailed representation vide Annexure-4 pending consideration of the Collector, Bhadrak. Keeping in view the serious allegation, this Court in disposal of the Writ Petition directs the Collector, Bhadrak to look into the grievance of the Petitioners vide Annexure-4 and take a lawful decision on the same while also Page 1 of 2 // 2 // keeping in view the plea taken by the Petitioners in the Writ Petition and further also providing opportunity of hearing to the Petitioners by completing such exercise at least within a period of two months. This Court for the nature of allegation involved also involves a spot verification report to be prepared under the direction of the Collector. For two months there shall be no construction on the land alleged.

4. The Writ Petition stands disposed of.
