A Supplementary Affidavit is filed in Court today. Let the same be kept with the records.
The grievance of the writ petitioner in this proceeding is in respect of a "Demand Memo". Requiring the petitioner to pay punitive charges for overloading of goods to the tune of 2.80 tonnes. The petitioner had booked on indent demand a parcel van in respect of Train No. 12869 (Wadi Barder to Howrah) and he claims to have loaded 21.6 tonnes for which freight charges appear to have been deposited.
In the Supplementary Affidavit filed in Court today, it has been submitted that the petitioner had loaded HL cloth, dry food, woolen garments and shoes etc., in the said space. In the writ petition, the petitioner had stated that there were perishable goods and drugs in the consignment. A different stand is being taken now. Let the petitioner give full particulars of the goods loaded to the respondent no. 5 within a period of seven days. If the respondent no. 5 finds that there is no perishable goods involved in the consignment, he shall direct re-weighment in terms of existing policy and practice on payment of charges by the petitioner. Such exercise shall be completed within a period of two weeks.

In the event the respondent no. 5 finds that there are no perishable goods involved, the re-weighment shall be done on a stationary weighing scale.
