1. This is an Application filed by the Plaintiffs seeking exemption from instituting pre-litigation Mediation under Section 12A of the Commercial Courts Act, 2015 ("CC Act").
2. As the present matter contemplates urgent interim relief, in light of the judgment of the Supreme Court in Yamini Manohar v. T.K.D. Krithi, 2023 SCC OnLine SC 1382, exemption from the requirement of pre- institution Mediation is granted.
3. The Application stands disposed of. I.A. No. 23255/2025 (Exemption from advance service to the Defendants)

5. Mr. Satvik Varma, learned Senior Counsel for the Plaintiffs, submitted that there is a real and imminent likelihood that the Defendants may take immediate steps to dispose of, conceal or suppress their infringing business operations and digital footprints bearing the deceptively similar Trade Mark.
6. In view of the fact that the Plaintiffs have sought an urgent ex-parte ad-interim injunction, the exemption from advance service to the Defendant Nos.2 to 25 is granted as the learned Counsel for Defendant No. 1 has entered appearance. Service of the entire paperbook shall be made to the learned Counsel for the Defendant No. 1.
7. The Application is disposed of. CS (COMM) 994/2025
8. Let the Plaint be registered as a Suit.
9. Issue Summons. The learned Counsel for Defendant No. 1 accepts Summons.
10. Let the Summons be served to the remaining Defendants through all permissible modes upon filing of the Process Fee.
11. The Summons shall state that the Written Statement(s) shall be filed by the Defendants within 30 days from the date of the receipt of Summons. Along with the Written Statement(s), the Defendants shall also file Affidavit(s) of Admission / Denial of the documents of the Plaintiffs, without which the Written Statement(s) shall not be taken on record.
12. Liberty is granted to the Plaintiffs to file Replication(s), if any, within 30 days from the receipt of the Written Statement(s). 16. The present Application has been filed on behalf of the Plaintiffs under Order XI Rule 1(4) of the CPC as applicable to Commercial Suits under the CC Act seeking leave to place on record additional documents.
17. The Plaintiffs are permitted to file additional documents in accordance with the provisions of the CC Act and the Delhi High Court (Original Side) Rules, 2018.

21. The present Suit has been filed for permanent injunction restraining infringement of the Trade Marks as encapsulated in Paragraph Nos. 22.4 to 22.7 of this Order and passing off of the Trade Marks as encapsulated in Paragraph No. 22.8 ("Plaintiffs' Trade Marks") along with ancillary reliefs.

22. The learned Senior Counsel for the Plaintiffs made the following submissions:
22.1. Plaintiff No. 1, Aries Agro Limited is a company incorporated in 1969 under the Companies Act, 1956 and at present governed by the Companies Act, 2013 having its Registered Office at Mumbai, Maharashtra. Plaintiff No. 2, Mirabelle Agro Manufacturing Private Limited is a wholly owned subsidiary of Plaintiff No. 1 having its registered address at the same location as Plaintiff No. 1 and incorporated on 26.12.2019.
22.2. The Plaintiffs are into the business of manufacturing micronutrients and other nutritional products for plants and animals.
22.3. The Plaintiffs have manufacturing facilities and offices at 35 locations all over the country and a team of 1,196 highly qualified and driven employees functioning in 26 states across India and 8 countries. The Plaintiffs have 140 brands customized based on crops, soil and agro-climatic requirements reaching 9 million farmers over 5 decades and 21 organically certified products. 22.4. The Plaintiffs have the Plaintiffs' Trade Marks registered under Classes 1, 5 and 35. The details of the registration of the Plaintiffs' Trade Marks in the Plaintiff No. 1's name and the standalone word 'Aries' are set out hereunder:

Since atleast 1976, the Plaintiffs' Trade Marks have been openly, continuously, and extensively used by the Plaintiffs in respect of the goods and services with a view to distinguish the same from those of others. The 'Aries' brand is synonymous with undisputed world-class quality and reliability amongst farmers and other customers using the products manufactured by the Plaintiffs. The total annual revenue for the last 4 financial years is of ₹2,600 crores. The total annual CS(COMM) 994/2025 Page 15 of 58 This is a digitally signed order. Defendant No. 1, Indiamart Intermesh Limited, Defendant No. 2, Agrim Wholesale Private Limited, Defendant No. 3, Hippo Innovation Pvt. Ltd. trading as MyStore, Defendant No. 4, Kalgudi and Defendant No. 5, Meesho Technologies Pvt. Ltd. are all e- marketplaces which provides a platform for sellers. Defendant Nos. 6 to 19 are sellers at Defendant No. 1. Defendant No. 20, Maihar Farmers Producer Company Limited, is a seller at Defendant No. 3. Defendant Nos. 21 to 23 are sellers at Defendant No. 4 and Defendant Nos. 24 and 25 are sellers at Defendant No.
5. Defendant No. 26 is Ashok Kumar / John Doe. Defendant Nos. 1 to 5 are intermediaries, which are selling the products of the Plaintiffs with the Plaintiffs' Trade Marks on their e-commerce platforms and Defendant Nos. 6 to 25 are various sellers of the products of the Plaintiffs with the Plaintiffs' Trade Marks ("Infringing Goods").
22.11. The Plaintiffs came across a substantial number of listings of Infringing Goods which are identical to the goods and services with the Plaintiffs' Trade Marks on the e-commerce platform of Defendant No. 2 and subsequently, a physical meeting took place in New Delhi on 01.08.2025 between the Plaintiffs and Defendant No. 2. The prices of the products were listed below than the prices at which the products of the Plaintiffs were being sold without bearing any seller's details.
22.12. Upon investigation, the Plaintiffs came across various listings on CS(COMM) 994/2025 Page 16 of 58 This is a digitally signed order. The Order is downloaded from the DHC Server on 25/09/2025 at 21:34:23 Defendant No. 2's mobile application, vide which they were unauthorisedly selling / offering for sale of the Infringing Goods. 22.13. Between 04.08.2025 to 12.08.2025, various e-mails exchanged between the Plaintiffs and the Defendant No. 2 qua unauthorised and illegal sales and listing of Infringing Goods and other issues. However, Defendant No. 2 tried to wash off its hands by contending that it's an intermediary but refused to disclose names and details of sellers on its platform selling the Infringing Goods identical to the goods being sold by the Plaintiffs under the Plaintiffs' Trade Marks. The Plaintiffs sent an e-mail on 05.08.2025 requesting for immediate cease and desist from listing and selling 'Aries' products on its platform ("Cease and Desist Notice").
22.14. On receiving no reply to the Cease and Desist Notice from Defendant No. 2, the Plaintiffs sent a reminder e-mail to Defendant No. 2 on 08.08.2025. Defendant No. 2 sent its reply on 09.08.2025 seeking more time from the Plaintiffs and subsequently, on 12.08.2025, Defendant No. 2 sent a detailed reply denying all the issues raised by the Plaintiffs. Defendant No. 2, while claiming to be an intermediary, is in fact selling the Infringing Goods illicitly without the authorisation or approval of the Plaintiffs, through its mobile application wherein the screenshot function has been disabled. The links to the goods being sold at Defendant No. 2 are accessible to those who are the registered users of Defendant No. 2. 22.15. Upon further investigation, the Plaintiffs came across various CS(COMM) 994/2025 Page 17 of 58 This is a digitally signed order. The Order is downloaded from the DHC Server on 25/09/2025 at 21:34:23 listings on the platforms of Defendants Nos. 1 to 5 and Defendant Nos. 6 to 25 as the sellers, vide which Defendant Nos. 6 to 25 are carrying out their nefarious activities of soliciting orders, marketing, advertising, offering for sale, unauthorisedly and illegally selling and making available / delivering their Infringing Goods under the Plaintiffs' Trade Marks. 22.16. In Indiamart Intermesh Ltd. v. PUMA SE, 2025 SCC OnLine Del 4165 wherein this Court held that safe harbour protection under the Information Technology Act, 2000 is available, but conditional as intermediaries must act diligently, respond swiftly to notices, remove infringing content when aware, etc. It balances trade mark protection especially against counterfeits with operational realities of online platforms. The Court restrained over strict liability on platforms for seller actions unless there is evidence of active participation or negligence. The Court emphasised that Indiamart's function is to provide users access to a business-to-business platform containing information placed by the suppliers registered on Indiamart. Indiamart also provides certain value-added services. Indiamart indicates certain sellers as 'verified'. However, it is explained that the term 'verified' only indicates that the phone number of the seller is verified. It would be necessary for Indiamart to prominently indicate that Indiamart has only verified the phone number of the sellers thus, no one is deceived to believe that Indiamart is offering any other assurance in this regard. If any of the value-added services, which are offered by Indiamart for consideration are found to encourage CS(COMM) 994/2025 Page 18 of 58 This is a digitally signed order. The Fertilizer (Control) Order dated 25.09.1985 ("FCO") passed by the Ministry of Agriculture and Rural Development (Department of Agriculture and Cooperation) vide Notification No. 11-3/83-STU regulates the quality, price, distribution, and sale of fertilizers in India along with to ensure that fertilizers meet prescribed standards of quality before being sold to farmers and to provide rules for manufacturers, importers, dealers, and testing laboratories. The relevant Clauses of the FCO are:
a. Clause 7 states that industrial dealers require to obtain registration for selling fertilizers for non-agricultural (industrial) use. Dealers selling fertilizers for agricultural purposes must obtain authorization from the registering authority and a separate registration / authorization is needed for each place of business, subject to renewal. No one can deal in fertilizers without valid registration / authorization under this Clause.
b. Clause 8(1) states that manufacturers, importers, or pool handling agencies must appoint authorized wholesale / retail dealers to sell fertilizers.
c. Clause 8(2) states that such appointments require prior written authorization, and dealers must comply with FCO conditions.

23. The learned Counsel for Defendant No.1 submits that Defendant No. 1 shall comply with the direction to take down the listings of the Infringing Goods with the Plaintiffs' Trade Marks pursuant to the Order passed by this Court.

Having considered the submissions advanced by the learned Senior Counsel for the Plaintiffs, the learned Counsel for Defendant No. 1, the pleadings, and the documents on record, it is clear that the Plaintiffs are the registered proprietor of the Plaintiffs' Trade Marks with the earliest registration in 1976. The Plaintiffs have been using the Plaintiffs' Trade Marks continuously since 1976 with respect to micronutrients and other nutritional products for plants and animals. The Plaintiffs have demonstrated the goodwill and reputation acquired by the Plaintiffs' Trade Marks. The Plaintiffs have spent a considerable amount on advertising and business promotion and recorded an expenditure in the last 4 financial years is of ₹132 crores. The Defendants use of the Plaintiffs' Trade Marks on the Infringing Goods is prima facie dishonest and nothing but an attempt to ride the goodwill and reputation of the Plaintiffs' Trade Marks so as to cause confusion in the market.
25. Accordingly, Plaintiffs have made out a prima facie case for grant of an ex-parte ad-interim injunction. Balance of convenience is in favour of the Plaintiffs and against the Defendants. Irreparable injury would be caused to the Plaintiffs if an ex-parte ad-interim injunction is not granted.

Defendant Nos. 2, 6 to 26, their directors, partners, servants, agents, dealers, retailers, distributors and all other persons acting for and on their behalf as the case may be, from are restrained from either directly or indirectly engaging in manufacturing, offering for sale, unauthorised and illegal selling, marketing / advertising, adopting, using and / or dealing in any manner with respect to any product or service including the suit products so as to pass off and / or enable others to pass off the Defendant Nos. 2, 6 to 26's Infringing Goods with the Plaintiffs' Trade Marks as set out in Paragraph No. 22.4 to 22.8 of this Order. iii.
